How Trump could become a national-level version of Jesse Ventura

How about this for a black swan?

Americans haven’t elected a take-no-prisoners executive bound to drag the country into a hard-right populist dystopia.

Instead, they’ve elected a third-party-style insurgent (albeit from within the Republican Party) who will struggle to make allies in either congressional party and fizzle out after four years of smoke, but not a lot of noise — or economic or policy accomplishments.

It already happened — in Minnesota. In 1998, voters weary of grey establishmentarians, elected instead the flamboyant Jesse Ventura, a former professional wrestler. Christening himself as Jesse ‘the Mind’ Ventura, he narrowly clipped Republican Norm Coleman (then St. Paul mayor) and Democrat Skip Humphrey (the son of the former vice president). But Ventura, in his one lonely term as governor, transformed a $4 billion budget surplus into a $4.5 billion deficit and otherwise spent most of his time fighting with the media and with members of the state legislature.

Ventura, who ran and governed on the quirky Reform Party ticket founded in 1996 by Ross Perot, lent his support in 2000 to Trump’s nascent bid for the Reform Party’s presidential nomination. Trump eventually lost to the anti-trade, anti-immigrant conservative commentator Pat Buchanan.

Far from a lapse to 1930s-style authoritarianism, perhaps the Trump administration will be far more like a national version of the Ventura experiment. Trump has already squandered nearly a quarter of his first 100 days on distractions and controversy.

A country-by-country look at Trump’s immigration executive order

There’s a neighborhood in Los Angeles, commonly known as Tehrangeles, that is home to up to a half-million Persian Americans, most of whom fled Iran after the 1979 Islamic republic or who are their second-generation children and third-generation grandchildren, all of them American citizens. 

The neighborhood runs along Westwood Boulevard, and it is home to some of the wealthiest Angelinos. But under the executive action that US president Donald Trump signed Friday afternoon, their relatives in Iran will have a much more difficult time visiting them in Los Angeles (or elsewhere in the United States). The impact of the order, over the weekend, proved far deeper than originally imagined last week when drafts of the order circulated widely in the media.

The ban attempts to accomplish at least five different actions, all of which began to take effect immediately on Friday:

  • First, the order institutes a ban for 90 days on immigrants from seven countries — Iran, Iraq, Syria, Yemen, Sudan, Somalia and Libya.
  • Secondly, the ban initially seemed to include even US permanent residents with valid green cards with citizenship from those seven countries (though the Department of Homeland Security was walking that back on Sunday, after reports that presidential adviser and former Breitbart editor Steve Bannon initially overruled DHS objections Friday). But it also includes citizens of third countries with dual citizenship (which presents its own problems and which the White House does not seem to be walking back).
  • Third, it institutes a 120-day freeze on all refugees into the United States from anywhere across the globe and an indefinite ban for all refugees from Syria.
  • Fourth, it places a cap of 50,000 on all refugees for 2017 — that’s far less than nearly 85,000 refugees who were admitted to the United States in 2016, though it’s not markedly less than the nearly 55,000 refugees admitted in 2011 (the lowest point of the Obama administration) and it’s more than the roughly 25,000 to 30,000 refugees admitted in 2002 and 2003 during the Bush administration.
  • Fifth, and finally, when the United States once again permits refugees, it purports to prioritize admitting those refugees ‘when the person is a religious minority in his country of nationality facing religious persecution.’ It’s widely assumed that this is a back-door approach to prioritizing Christian refugees. More on that below.

In practice, it’s already incredibly difficult to get a visa of any variety if you are coming from one of those countries, with a few exceptions. But formalizing the list is both overbroad (it captures mostly innocent travelers and refugees) and underbroad (it doesn’t include potential terrorists from other countries), and experts believe it will hurt US citizens, US businesses and bona fide refugees who otherwise might have expected asylum in the United States. On Sunday, many Republican leaders, including Arizona senator John McCain admitted as such:

Ultimately, we fear this executive order will become a self-inflicted wound in the fight against terrorism. At this very moment, American troops are fighting side-by-side with our Iraqi partners to defeat ISIL. But this executive order bans Iraqi pilots from coming to military bases in Arizona to fight our common enemies. Our most important allies in the fight against ISIL are the vast majority of Muslims who reject its apocalyptic ideology of hatred. This executive order sends a signal, intended or not, that America does not want Muslims coming into our country. That is why we fear this executive order may do more to help terrorist recruitment than improve our security.

On the campaign trail, Trump initially called for a ban on all Muslims from entering the country; when experts responded that such a broad-based religious test would be unconstitutional, Trump said he would instead extend the ban on the basis of nationality.

Friday’s executive action looks like the first step of institutionalizing the de facto Muslim ban that Trump originally promised (thought it would on its face be blatantly unconstitutional).

Of course, as many commentators have noted, the list doesn’t contain the countries that match the nationalities of the September 2001 hijackers — mostly Saudi Arabia. But it doesn’t contain Lebanon, though Hezbollah fighters have aligned with Syrian president Bashar al-Assad in that country’s civil war. It doesn’t include Egypt, which is the most populous Muslim country in north Africa and home to one of the Sept. 2001 terrorists. Nor does it include Indonesia, the world’s most populous Muslim country. Nor Pakistan nor Afghanistan, where US troops fought to eradicate forms of hardline Taliban government and where US troops ultimately tracked and killed Osama bin Laden.

This isn’t a call to add more countries to the list, of course, which would be even more self-defeating as US policy. But it wouldn’t surprise me if Bannon and Trump, anticipating this criticism, will use it to justify a second round of countries.

In the meanwhile, the diplomatic fallout is only just beginning (and certainly will intensify — Monday is the first full business day after we’ve read the actual text of Friday’s executive order). Already, Germany’s chancellor Angela Merkel, citing the obligations of international law under the Geneva Conventions, disavowed the ban. Canadian prime minister Justin Trudeau used it as an opportunity to showcase his country’s openness to immigration and welcomed the refugees to Canada. Even Theresa May, the British prime minister who shared a stage with Trump in Washington on Friday afternoon, distanced herself from the ban, and British foreign minister Boris Johnson called it ‘divisive.’

But the most direct impact will be felt in relations with the seven countries directly affected by the ban, and there are already indications that the United States will suffer a strategic, diplomatic and possible economic price for Trump’s hasty unilateral executive order.  Continue reading A country-by-country look at Trump’s immigration executive order

Pulling out of TPP: the first major foreign policy error of the Trump administration

Keeping a promise from his 2016 campaign, US president Donald Trump formally pulled the United States out of the Trans-Pacific Partnership today, a 12-nation trade and investment agreement in the works for nearly a decade.

Though the move will win plaudits from both the populist right and the anti-trade left (including Vermont senator Bernie Sanders, the former Democratic presidential candidate) Trump’s move is the first major unforced foreign policy error of the Trump administration. TPP opposition brings together an ascendant protectionist coalition that includes many of Trump’s populist supporters, but also many rust-belt and leftist Democrats and many organized labor officials.

In junking the US role in the TPP, a death knell for the trade accord, Trump has now cleared the way for the People’s Republic of China to set the baseline for trade rules across the Asia-Pacific region, negating hopes from the previous Obama administration to ‘pivot’ the country’s strategic and economic orientation toward the fast-growing region and backtracking on a decades-long bipartisan consensus that the United States takes an open and, indeed, leading approach to the ideal of free trade.

Though the general terms of global trade will continue to be governed by the World Trade Organization, regional trade deals allow for countries to deepen trade ties in ways that go beyond the standard WTO rules and to develop strategic alliances.

Trump railed against the TPP from the earliest months of his presidential campaign, arguing that it gave China an unfair advantage:

The TPP is horrible deal. It’s a deal that was designed for China to come in, as they always do, through the back door and totally take advantage of everyone.

But China was never a signatory to the TPP and, indeed, was never party to the 12-country talks that also included stalwart US allies like Australia, New Zealand, Canada and Japan. The US national interest in negotiating and signing an agreement like the TPP would have been to create a trade paradigm in the region that seeks to help US interests in contrast to Chinese interests and, of course, to draw both traditional allies and new allies closer to the United States economically and strategically.

If anything, the TPP provided a framework to protect the United States from Chinese competition. To the extent that American manufacturing jobs have suffered as a result of international trade, and from trade with China, in particular, it has come from the decision in 2000 by a Republican Congress and Democratic president Bill Clinton to grant permanent normal trade relations to China (which had previously been subject to an annual congressional vote) and in 2001 to admit China to the WTO, lessening the ability of the United States to deploy protective tariffs against China.

Tillerson’s not a bad choice for State; he’s just a bad choice for Trump’s administration.

ExxonMobil CEO Rex Tillerson is rumored to be Donald Trump’s pick to serve as Secretary of State.

In a ‘normal’ presidential administration, nominating the CEO of one of the world’s leading oil companies as the chief diplomatic officer of the United States would be a maverick, refreshing and, perhaps, inspiring choice.

After all, it takes some diplomatic skill to navigate the tangled shoals of doing business in some of the world’s leading oil producers, and foreign policy mandarins in Washington certainly have no monopoly on international affairs. As CEO of ExxonMobil, Rex Tillerson has embraced the need for alternative energy sources, he has demonstrated that he understands the global challenges of climate change, and he has been a canny and creative executive. He’s obviously a very intelligent guy.

In Donald Trump’s administration, however, Tillerson would be a disastrous choice — for at least two reasons.

Clinton clinches nomination after 24 years as national political figure

This is a very good piece, and Hillary Clinton’s nomination is of course a milestone that means that, long after many other democratic countries in the world, the United States has, for the first time, a real chance to elect its first female president.USflag

From Victoria Woodhull in 1872 (whose running mate was Frederick Douglass) to Shirley Chisholm in 1972 to Pat Schroder in 1988 to Carol Moseley Braun in 2004, there’s a long line of credible women who have challenged for the presidency, and Clinton’s accomplishment builds upon the stepping stones that they laid down (not least of all her own run for the presidency in 2008).

But without denying this moment’s importance, what’s even more fascinating to me is that someone who has been at the center of American political life for 24 years (I’m not counting over a decade as Arkansas’s first lady), with a record, warts and all, in the first Clinton administration, eight years in the US Senate and four years at State has won a major-party nomination.

The trend, increasingly, has been rapid-fire rises to the top from people who seemingly come out of nowhere. Barack Obama. In a way, George W. Bush, too. Jimmy Carter. Bill Clinton. Enrique Peña Nieto in Mexico, Justin Trudeau in Canada, Tony Blair and David Cameron in Britain. There’s just something undeniably attractive about a ‘shiny new toy’ in electoral politics.

How I expect the 2016 Republican nomination race to play out

It’s not often that I write about American politics because there are already so many pundits doing it, and the comparative advantage of a website like Suffragio lies in deeper analysis of global electoral politics and foreign policy informed by that analysis. USflag

But we’re now just over three weeks away from the most competitive Republican presidential nomination contest in memory, and we’re six months into the era of TrumpismoFor what it’s worth, no one knows exactly how the spring nominating process will end because there are so many variables — and you shouldn’t trust anyone who says otherwise.

Still, we’re not on Mars and, while there are certainly new factors in 2016 that matter more than ever, there is deep precedential value from prior contests.

So here’s one perspective on how the race might ultimately turn out, based on observing primary contests for over 20 years. Step back from the horse race, step back from the scorecards of last night’s debate, step back from the peculiarities of Iowa and New Hampshire. Envision what the Republican general election campaign in November 2016 will have to offer to an electorate where young voters, women (possibly in historical numbers) and racial and ethnic minorities will still favor the Democratic ticket, barring a catastrophic turn in voting patterns or economic conditions.

Who, given the current 15-candidate field, will Republicans want running that campaign?

What a Republican Senate means for world politics

On Tuesday, when tens of millions of US voters go to the polls, they are very likely to deliver a US Senate majority to the Republican Party.USflag

Six years into the administration of Democratic president Barack Obama and four years after the midterm elections that delivered control of the US House of Representatives to the Republicans and conservative speaker John Boehner, most polls and poll aggregate forecasts give the Republicans anywhere from a strong (70%) to moderate (74%) to an overwhelming (96%) chance to retake the Senate.

It’s not uncommon for the ‘six-year itch’ to reward the non-presidential party with gains in midterm elections. Throughout the post-war era, in every midterm election during the second term of a reelection president, the opposition party has made gains each time — with the exception of 1998, when the Democrats benefited from a strong economy and Republican overreach in pursuing  what would eventually become impeachment hearings against US president Bill Clinton over alleged perjury in the Monica Lewinsky affair.

It’s also not unheard of that foreign policy can drive larger narratives about presidencies.

Most recently, in 2006, Democrats recaptured both houses in midterm elections, forcing then-president George W. Bush to accept the resignation of his defense secretary Donald Rumsfeld, in light of the war in Iraq’s unpopularity and the unfolding sectarian civil war taking place there despite US military occupation. As it turns out, the 2006 midterms paved the way for a much more moderate tone to the final two years of the Bush administration and a change in strategy under Robert Gates, Rumsfeld’s successor, who ultimately stayed on as defense secretary until 2011, lending a sense of continuity to the Obama administration’s approach to defense policy.

Six important points from Clinton’s foreign policy interview

Over the weekend, US president Barack Obama gave a wide-ranging interview on foreign policy with New York Times columnist Thomas Friedman. USflag

But it’s the interview that The Atlantic‘s Jeffrey Goldberg conducted with former US secretary of state Hillary Rodham Clinton that’s garnered much more attention. With Clinton leading polls for both the Democratic presidential nomination and general election in 2016, her interview was widely viewed as creating space between her own views on US foreign policy and those of the current president, who defeated her in 2008 for the Democratic nomination before appointing her as the top US diplomat in the first term of his presidential administration.

The most controversial comment seems to be Clinton’s criticism that the Obama administration’s mantra of ‘don’t do stupid shit‘ isn’t what Clinton calls an ‘organizing principle’ for the foreign policy of any country, let alone a country as important as the United States.

The headline in the The New York Times? ‘Attacking Obama policy, Hillary Clinton exposes different world views.’

Chris Cillizza at The Washington Post endeavored to explain ‘What Hillary Clinton was doing by slamming President Obama’s foreign policy.’

The Clinton ‘slam,’ though, is somewhat overrated. She admits in virtually the same breath that she believes Obama is thoughtful and incredibly smart, adding that ‘don’t do stupid stuff’ is more of a political message than Obama’s worldview. For the record, Clinton claims that her own organizing principles are ‘peace, progress and prosperity,’ which might be even more maddeningly vague than ‘don’t do stupid stuff.’ After all, who’s against peace, progress or prosperity? Even if ‘don’t do stupid shit’ is political shorthand, and even if you don’t believe that the Obama administration’s foreign policy has been particularly successful, it’s political shorthand that  represents a sophisticated worldview about the respective strengths and limits of US foreign policy.

In any event, there’s an awful lot to unpack from the Clinton interview, both on the surface and from reading between the lines. You should read the whole thing, but in the meanwhile, here are six things that struck me from the interview about Clinton and what her presidential administration might mean for US foreign policy. Tsunis nomination draws scorn from Norwegians

Yet, even as he stumbled through an embarrassingly poor performance at a hearing on Thursday before the US Senate Foreign Relations Committee, Tsunis is set to become the next US ambassador to Oslo.

As US senator John McCain asked Tsunis about the ‘anti-immigration’ Framskrittspartiet (Progress Party), which is the junior member in Norway’s center-right governing coalition, the future ambassador stumbled with his answer or, as Norway’s newspapers phrased it, tråkket i salaten (trampled through the salad bowl).  

“You get some fringe elements that have a microphone and spew their hatred,” he said in the pre-appointment hearing. “And I will tell you Norway has been very quick to denounce them.”
McCain interrupted him, pointing out that as part of the coalition, the party was hardly being denounced.
“I stand corrected,”  Tsunis said after a pause.  “I would like to leave my answer at… it’s a very,very open society and the overwhelming amount of Norwegians and the overwhelming amount of people in parliament don’t feel the same way.”

Good grief.  This came after Tsunis referred to Norway’s ‘president’ — of course, there’s no such office because Norway is a constitutional monarchy.  By way of background, Tsunis is an attorney and a businessman from Long Island.  He founded Chartwell Hotels, which operates properties for InterContinental Hotels and other hotel chains.  Though he supported McCain, a Republican, in the 2008 US presidential election, he bundled nearly $1 million in contributions for US president Barack Obama, a Democrat, in the subsequent 2012 presidential election, and he personally donated $267,244 to the Democratic Party in 2012 and $278,531 in 2010.  Tsunis is an active member of the Greek-American community and the Greek Orthodox Church, which begs why anyone in the Obama administration would send him… to Norway.

McCain, not thrilled with the response, thanked Tsunis and the ‘incredibly highly qualified group of nominees.’  But perhaps McCain should leave aside the snark himself — Norwegians might also take issue with his characterization of the Progress Party solely as an anti-immigration party.  In fact, the party has its genesis in the anti-tax movement of the 1970s.  It’s certainly in favor of tougher immigration restrictions, and it’s probably Norway’s most controversial major party.  But it’s not nearly as xenophobic as some of Europe’s other parties (e.g., Marine Le Pen’s Front national in France), and it represents something greater in Norway as a party of rupture.

Other mainstream center-left and center-right parties largely support Norway’s social welfare state, just as they support the relatively fiscal conservative steps to limit spending from Norway’s oil largesse.  The Progress Party wants to break away radically from the state-heavy welfare model, and it wants to spend more of Norway’s oil fund today.

That’s why Erna Solberg, the leader of Høyre (the ‘Right,’ or more commonly, the Conservative Party) is Norway’s prime minister today instead of Progress Party leader Siv Jensen.  Solberg pulled the Conservative Party toward a more moderate policy path that’s essentially the center-right analog to the long-governing Arbeiderpartiet (Labour Party), which lost the September 2013 elections after two terms in power under former prime minister Jens Stoltenberg.

It doesn’t seem like it would be so incredibly hard for the Obama administration to bring even someone woefully uniformed about Norway’s political, cultural and economic basics up to speed — even Tsunis!  That the Obama administration chose not to do so is perhaps the most egregious oversight of all. 

The previous ambassador to Norway, Barry White, who served from 2009 to 2013, had at least some basis in international affairs as the longtime managing partner of Foley Hoag LLP, and as the chair of Lex Mundi, a global association of international, independent law firms.  His predecessor, Benson Whitney, served from 2005 to 2009 under former president George W. Bush.  A native of Saint Paul, Minnesota, Whitney came from the US state with the greatest number of Norwegian-Americans by far.  As then-president of the Minnesota Venture Capital Association, he could argue that his experience in venture capital and investments would bode well to serve as a representative to the country with the world’s largest sovereign wealth fund.

It’s not just Tsunis. The Obama administration’s nominee to serve as the ambassador to Hungary, by the way? Colleen Bradley Bell, a television producer and — you guessed it — philanthropist and top Obama campaign donor.  At a time when Hungary faces some of the most troubling accusations of democratic backsliding within the European Union, and with Hungarian prime minister Viktor Orbán set to win another majority under a new (troubling) electoral system in April, the United States is sending the producer of television daytime soap opera ‘The Bold and the Beautiful.’

John McCain is the Jimmy Carter of the right: a free radical running his own shadow diplomacy

Typically, US foreign policy is conducted at a very concentrated level among a top coterie of constitutional officers and White House staffers.  The 535-member US Congress likes to get in on the act too, from time to time, just as it did when US president Barack Obama called for a congressional vote on potential military action against Bashar al-Assad in punishment for his regime’s use of chemical warfare on August 21.

But sometimes, there are free agents who, by benefit of their success in public life, can conduct a virtual shadow foreign policy.  For over three decades, the most exceptional example has been former president Jimmy Carter, whose post-presidential diplomacy has caused fits for many of his successors in the Oval Office, including Democrats like Obama and Bill Clinton as well as Republicans like George W. Bush.

But even before his failed 2008 presidential run, McCain has increasingly become another Jimmy Carter — in his willingness to engage in shadow diplomacy, often to the dismay of both the Bush and Obama administrations.  Except Carter is liberal and dovish and McCain is conservative and hawkish.

Carter honed his approach as a mercenary-for-peace in the 1990s, when he attempted to use his special status as a former US president to broker peace everywhere from Haiti to Sudan.  He visited Cuban president Fidel Castro in 2002, despite the fact that US-Cuban relations have been strained since the 1959 Cuban revolution and the 1963 missile crisis, and he endorsed the electoral process in Venezuela’s 2004 recall election that kept Hugo Chávez, another anti-American leader, in office.  Carter spoke out early and often against the Bush administration’s push to invade Iraq in 2003 to a rare degree among former US presidents, and he remained a critic of the Bush administration’s Iraq policy throughout the 2000s.  Carter, most recently, has criticized the Obama administration for the use of unmanned drones in Pakistan, Yemen and elsewhere, and for keeping the Guantánamo Bay prison open for detainees suspected of terrorism.

You might think that Carter’s approach is a brilliant way to nudge US foreign policy toward more peaceful outcomes — he won the 2002 Nobel Peace Prize largely on the basis of his post-presidential work.  But you might also think that Carter’s approach complicates often delicate situations by introducing another (unwelcome) cook to the kitchen, and Carter’s diplomacy typically causes more frustration than enthusiasm from within the White House.

Likewise, the Obama administration won’t welcome McCain’s latest move, which will raise the decibel level with what’s certainly likely to be a provocative Pravda piece.  It comes two days after McCain saw the need to release his own statement about Moscow’s mayoral elections.  (Isn’t that the U.S. state department’s job rather than the ranking member of the US Senate’s armed services committee?)

Kerry’s forceful remarks on Syria fail to explain why Assad’s to blame

Max Fisher at The Washington Post writes that Kerry’s remarks amounted to a ‘war speech,’ that the Obama administration has all but decided to respond to the chemical attack with air strikes.  I don’t disagree with that assessment, but the oddest thing about Kerry’s seven minutes on Syria was how much of it he spent arguing that the attacks were real — consider the following exchange:

Last night, after speaking with foreign ministers from around the world about the gravity of this situation, I went back and I watched the videos — the videos that anybody can watch in the social media, and I watched them one more gut-wrenching time. It is really hard to express in words the the human suffering that they lay out before us.  As a father, I can’t get the image out of my head of a man who held up his dead child, wailing while chaos swirled around him, the images of entire families dead in their beds without a drop of blood or even a visible wound, bodies contorting in spasms, human suffering that we can never ignore or forget. Anyone who could claim that an attack of this staggering scale could be contrived or fabricated needs to check their conscience and their own moral compass.  What is before us today is real, and it is compelling.

It’s no secret that I’m a fan of John Kerry (pictured above) — he’s had a strong start at State and that follows a generally impeccable senatorial record of thoughtful engagement on foreign affairs.  But with all due respect, I certainly hope the chief diplomat of the United States of America is spending more time reviewing the intelligence that the U.S., British and French governments allegedly have that implicates the Syrian president Bashar al-Assad in the chemical attack than watching shock footage on YouTube.

No one is arguing that the attack was contrived or fabricated — it’s a horrific slaughter that deserves a united and firm response from the international community conveying that the use of chemical weapons to kill civilians, including women and children, is unacceptable.  What remains at issue is determining who was responsible for the attack, and that’s why it was odd to watch Kerry spend more time knocking down a straw-man argument than explaining why the U.S. government is so sure that Assad was responsible for the attack.  Earlier today, Saleh Muslim, head of the Kurdish Democratic Union Party (PYD), who has clashed with both pro-Assad and anti-Assad forces, said that he doesn’t believe Assad is responsible for the attacks.  It’s a real question, and the U.S. media and the rest of the world should demand an answer.

What’s staggering is that, with all signs pointing to U.S. and British military poised to launch some kind of strike against Assad, the Obama administration still hasn’t made the case for why it believes that Assad — and not anti-Assad extremists looking to draw the international community into Syria’s two-year civil war — is to blame.  As many commentators have written, the timing of last week’s attack is incredibly suspicious, given that U.N. weapons inspectors were in Damascus during the attacks and that Assad has generally been gaining ground against the opposition, and there’s plenty of reason why the more radical elements among the anti-Assad opposition want to provoke the world’s ire against Assad.

It’s generally undisputed that Assad has stockpiled chemical weapons in the past, while we don’t know if any rebel group of the opposition now have access to them.  But that’s hardly a smoking gun.

The fact that Assad denied U.N. experts to inspect the scene for five days (and then allowed only 90 minutes of access today) is highly suspicious.  But in a court of law in the United States, that would amount to circumstantial evidence.  Remember that Saddam Hussein hedged over whether he had weapons of mass destruction in 2002 and 2003 mostly because he wanted to deter neighboring Iran.  Moreover, I can think of a half-dozen reasons why the Assad regime might hesitate to allow United Nations inspectors into the affected area.  (If Assad wasn’t actually responsible for the chemical attack, do you think he has enough control to guarantee the safety of U.N. inspectors from anti-Assad rebels?)

The international community deserves more from the United States, given its track record of failed intelligence over the proliferation of weapons of mass destruction (notably nuclear weapons) in Iraq in 2003.  That ‘slam dunk’ intelligence justified an eight-year military effort that catalyzed massive amounts of violence in Iraq.  New revelations this morning from Foreign Policy detailing the U.S. government’s complicity and acquiescence in the use of chemical weapons by then-ally Saddam Hussein in Iraq’s war against Iran in the 1980s only underscore the troublesome record that the United States has accrued on this issue. U.S. says ‘very little doubt’ Assad responsible for Syrian chemical warfare, preps possible intervention

The international response to last Wednesday’s chemical warfare attack on the outskirts of Damascus is fast congealing, with U.S., British and French intelligence all pointing to the regime of Bashar al-Assad as the culprit.USflagfreesyria Syria Flag Icon

An official in the administration of U.S. president Barack Obama said Sunday morning that there’s ‘very little doubt’ that Assad perpetrated the attack.  French president François Hollande said earlier today that there was ‘a body of evidence indicating that the August 21 attack was chemical in nature, and that everything led to the belief that the Syrian regime was responsible for this unspeakable act.’

Obama and U.K. prime minister David Cameron have discussed the possibility of some form of military intervention, according to The Guardian and other news sources.  Meanwhile, the Syrian regime, under pressure from its Russian and Iranian allies, has agreed to allow U.N. weapons experts to inspect the site of the attacks.  In a sour irony, U.N. inspectors were already in Damascus earlier this week when the attack occurred for the purpose of determining the extent of potential chemical warfare earlier this spring.

The outset burden on Western governments is to connect the dots to make clear why they believe Assad is responsible — a decade ago, U.S. and British intelligence claimed they had a ‘slam dunk’ case that Iraqi president Saddam Hussein was developing weapons of mass destruction,  launching a unilateral attack on what turned out to be incorrect intelligence.  If anything, there’s ample evidence in the revelations about PRISM and the Internet snooping by the U.S. National Security Agency that we shouldn’t necessarily take the governments of even liberal democracy at their word.

Remember that the timing of the chemical attacks is incredibly suspicious — Assad’s forces are generally winning via-à-vis the opposition forces in Syria, so it’s not incredibly clear why Assad would order a chemical attack now, especially under the noses of U.N. chemical weapons inspectors.  But given the Obama administration’s position that use of chemical weapons is a ‘red line’ that, if crossed, will merit an international response, there’s every reason for opposition forces to use a small-scale attack to try to draw U.S. and European power against Assad, and other radical Sunni elements sympathetic to both the anti-Assad forces and terrorist groups like al-Qaeda are more than happy to bait the West into intervening in the Syrian civil war.   But while it’s generally accepted that Assad has access to chemical weapons, it’s far less clear that any of the disparate rebel groups have them or have access to them.

Even if Assad is guilty of what amounts to a war crime, there’s still reason to tread lightly.  If Assad is responsible, he should face a wide berth of sanction under international law — those might include further tightening economic and diplomatic sanctions against Assad, his inner circle and the Syrian military, action sanctioned by the United Nations Security Council to destroy Assad’s chemical weapons or destroy his ability to deploy them in the future (including a no-fly zone), a fully empowered U.N. peacekeeping force, and an indictment from the International Criminal Court against Assad and the top military or other Syrian officials directly responsible for the chemical attack.

But even though U.S. defense secretary Chuck Hagel is preparing for ‘all contingencies,’ and U.S. warships in the eastern Mediterranean are already positioning for a potential attack, the international community can still respond in an affirmative way short of immediate U.S.-led military action.  Moreover, if Assad were removed tomorrow, Syria would still face a power vacuum, the potential for even more intense fighting between Shi’a/Alawite and Sunni Muslims within Syria and jockeying among various opposition groups, which range from secular Assad opponents to very conservative Islamic fundamentalists.  Those are just the known potential downsides for Syria — the unknown consequences and the potential adverse reaction in Iraq, Lebanon and elsewhere in the Middle East are more reason to tread lightly.

The next week is likely to bring even louder calls for the United States and/or the United Nations to act. To do something.

But the challenge for the Obama administration is that foreign policymaking in real time is very difficult, while political soundbytes are as easy as they are worthless.  There’s obviously a role for U.S. and international leadership to register a stand for human rights and against crimes of humanity.  But don’t trust anyone — in the United Kingdom, in the United States, in the Middle East — who has a ‘clear’ answer in mind for how the international community should now respond.

Don’t let hawks like U.S. senator John McCain convince you otherwise — the response to the latest turn in Syria’s conflict is more complicated than the polar choice of ‘doing nothing’ and launching a U.S.-led attack on Syria, guns-a-blazin’.  Given the U.S. history of intervention in the Middle East, and the horrific sectarian violence that followed the U.S.-led removal of Saddam Hussein in Iraq, it would be less controversial for the United Nations — not the United States — to take the lead in the organizing the international response.  Also don’t let liberal interventionists try to convince you that the United States should act immediately in order to avoid a Rwanda-style genocide in the Middle East.  Though the international community largely stood aside while 800,000 Tustis were hacked to death by Hutus in the 1994 Rwandan genocide, they welcomed the belated French intervention that served to provide relief and refuge to the genocidaires themselves.

Obama wisely treads softly in wake of Syrian chemical attack

In the aftermath of what now seems like a devastating and lethal chemical-weapons attack against thousands of civilians on the outskirts of Damascus early Wednesday, U.S. president Barack Obama is treading lightly on the evolving turn in the Syrian civil war — at least until we know more about the circumstances of the attack.USflagfreesyria Syria Flag Icon

In an interview today with CNN, Obama measured his words very carefully about what action he believes the United States or the international community can or should take in the wake of what amounts to a violation of international law:

Asked about claims by anti-regime activists in Syria that Bashar al-Assad’s government used chemical weapons in an attack that was said to have killed more than 1,300 people, Obama responded that officials are “right now gathering information” and that “what we’ve seen indicates that this is clearly a big event of grave concern.”

“It is very troublesome,” the president stressed.  Obama said U.S. officials are pushing “to prompt better action” from the United Nations, and are calling on the Syrian government to allow an investigation of the site of the alleged attack outside Damascus.

“We don’t expect cooperation (from the Syrian government), given their past history,” Obama conceded.  He quickly followed up with a warning, however, that “core national interests” of the U.S. are now involved in Syria’s civil war, “both in terms of us making sure that weapons of mass destruction are not proliferating, as well as needing to protect our allies, our bases in the region.”

His words are certain to disappoint both neoconservatives on the U.S. right and liberal interventionists on the U.S. left (many of which populate key roles within his administration) who see the attack as a clear violation of international law and an invitation for an aggressive response from the international community.  Already, U.S. senator John McCain is renewing calls for U.S. military intervention in Syria.

But there’s good reason for caution, and although it’s politically easier to make bold statements at a time of international crisis, Obama’s statement on Friday wisely reflects the ambiguity that we still know very little about the Syrian civil war, the anti-Assad opposition, the chemical attack itself and the potential unintended consequences of a more muscular U.S. or European response.

No one is comfortable to sit idly by when a thousand civilians have been gassed to death.  But in a world where human rights activists and conservative hawks alike are quick to pass judgment on the Obama administration’s reaction, it’s worth taking a moment to applaud Obama’s restraint.

We still don’t yet know who is responsible for the chemical attack nor do we actually know exactly what the attack agent was (reports indicate it was perhaps sarin, mustard gas or chlorine gas, though we won’t know until soil samples and other evidence is examined).  Although British foreign minister William Hague has gone further than the Obama administration in blaming Syrian strongman Bashar al-Assad for the attack, the public evidence does not point to the clear conclusion that Hague has drawn.  It’s widely accepted that Assad has access to chemical weapons, but after nearly two years of open civil war, it is not impossible for some of those weapons to have fallen into opposition hands — or worse. 

The timing, most of all, is incredibly odd, as BBC security correspondent Frank Gardner and others have noted.  If anything, Assad has been winning the civil war and reclaiming ground from the opposition.  The opposition’s repeated attempts to form a unified front against Assad have been mixed at best.  Meanwhile, a United Nations weapons inspection team was in Damascus this week to determine the extent of chemical warfare during the war.  It seems incredibly unlikely that Assad, who’s gained the upper hand, would launch a chemical weapons attack the very week when UN inspectors are merely kilometers away.  Allegations of previous chemical attacks stem from March and April — this is the first chemical attack in four months.

That opens the uncomfortable door to the notion that radical elements within the opposition, which ranges from secular Assad opponents to radical Sunni jihadists and al-Qaeda sympathizers, could have unleashed the attack.  Knowing that it is losing, the chemical attack might have been a false-flag gambit designed to inflame international opinion against Assad, especially given the position that Obama has taken that chemical weapon use is a ‘red line’ that will merit international action.  But it could be radical Islamic elements unassociated with the opposition, and it could be rogue elements of the Syrian army.

So far, Assad has refused to allow U.N. inspectors to examine the scene, which is an unacceptable response.  Even Assad’s allies like Russia are calling on him to allow U.N. access, and the longer Assad hesitates, the guiltier his regime looks.

But even if Assad was responsible for the attack — the worst chemical warfare since Iraqi president Saddam Hussein unleashed chemical weapons in the 1980s against his own people and on the battlefield against Iran — there’s still reason to tread lightly. As Rowhani takes power, U.S. must now move forward to improve U.S.-Iran relations

In 1995, months before the administration of U.S. president Bill Clinton found a peaceful solution at the Dayton peace talks to end the ethnic cleansing that had plagued Bosnia-Herzegovina for the previous four years, it found itself in the rare position of colluding with Iran to save Bosnian lives. USflagIran Flag Icon

At the time, the United States was unable, under a United Nations arms embargo that prohibited the shipment of arms to any parties in the ongoing Bosnian civil war, to provide Bosnian Muslims with the arms necessary to protect themselves from Serbian aggression.  The U.S. government suddenly found the Islamic Republic a useful ally.  Iran, lacking the same qualms of violating the U.N. embargo as a permanent member of the U.S. Security Council, happily shipped clandestine weapons to Bosnian Muslims, a move that Clinton-era officials tacitly encouraged in public on the pages of The New York Times:

A senior Administration official insisted today that the White House neither approved nor endorsed the Iranians’ actions. But after months in which President Clinton and his aides have been unable to persuade American allies to allow arms to flow legally to the Bosnian Muslims, one adviser to Mr. Clinton called Teheran’s motivations in making the shipments “understandable.”

The new flow of arms and ammunition has not yet put Bosnian Muslim forces on the same plane as their better-armed Bosnian Serb rivals, Administration officials said. But with the shipments of small arms, ammunition and anti-tank weapons amounting to perhaps hundreds of tons, they said it had made the Bosnian Government a more formidable force as a four-month-old cease-fire is about to expire.

Two months after the Times reported the critical role Iran, then in the final years of the presidency of Hashemi Rafsanjani, was playing to save Bosnian lives, Clinton signed an executive order banning U.S. businesses from trading with the Iranian government and implementing sanctions on oil and other trade with Iran.  It was a missed opportunity to thaw the 16-year diplomatic rupture with the United States.

Fast forward six years to the presidency of liberal reformer Mohammed Khatami shortly after the horrific al-Qaeda terrorist attacks on the United States in September 2001.  Within weeks, the United States pushed the radical Taliban from power, and it did so on the strength of the Northern Alliance, a group that had not only received material support from Tehran in the years leading up to 2001, but had also received Tehran’s tacit encouragement to work with the United States.  The Shiite government in Iran had much reason to be wary of both the radical Sunni, militant al-Qaeda, with its roots in the Arabian Peninsula to Iran’s west and the destabilizing Taliban to Iran’s east that had sent thousands of refugees into Iran by 2001.  But it was also another fertile opportunity for U.S.-Iranian relations, just months after Khatami secured an easy reelection.  As the Christian Science Monitor reported in October 2001:

Iran, which admitted last week that it has directed covert military and logistical support to the embattled Northern Alliance, also backs a transitional government that would give way to what one Foreign Ministry official has described as “a broad-based government set up under UN auspices.”

Iran’s reward at the time?  Bush included it in his three-country ‘axis of evil’ alongside North Korea and Iraq in January 2002.

Now fast-forward to last weekend.  During his inauguration on Sunday, Iran’s new president Hassan Rowhani urged a largely conciliatory and moderate course , contrasting sharply to the defiant, anti-American, anti-Israeli rhetoric of his predecessor Mahmoud Ahmadinejad.  But as Rowhani (pictured above, right, with Supreme Leader Ali Khamenei) gets down to the business of governing Iran, U.S. officials should realize that Iranian leaders feel like they have been burned by the United States before.
