Scotland passes same-sex marriage, joining England and Wales

Though the UK parliament in Westminster enacted same-sex marriage in July 2013 to great fanfare, the nature of devolution in the United Kingdom meant that Scotland’s parliament in Holyrood would have to pass its own version.United Kingdom Flag Iconscotland

The devolution process that began in 1997 under Labour prime minister Tony Blair created parliaments for Wales, Scotland and Northern Ireland.  But regional devolution ran deepest in Scotland — Wales opted for fewer regional powers than Scotland, and Northern Ireland’s parliament, created as part of the 1998 Good Friday Agreement, spent much of the 2000s suspended.  Ironically, that meant that for a brief period, same-sex marriage would be the law of the land in England in Wales, but not in the more socially liberal Scotland.

That changed today, when the Scottish parliament voted 105 to 18 in favor of enacting same-sex marriage.  First minister Alex Salmond, who leads a pro-independence government of the Scottish National Party (SNP) fast-tracked the bill to keep pace with Westminster.  Though the bill wasn’t without controversy, especially from within the Church of Scotland and other religious groups, support within the Scottish Labour Party and the Scottish Liberal Democrats meant that the bill was always likely to sail through Holyrood.

Though the major opposition to same-sex marriage in England and Wales came from within the Conservative Party of prime minister David Cameron (who himself supported marriage equality), the leader of the Scottish Conservative and Unionist Party, Ruth Davidson (pictured above), is herself gay and strongly supported the marriage equality effort in Scotland. Though the Tories hold just 15 seats in the 129-member Scottish parliament (compared to 65 seats for the SNP and 37 for Labour), Davidson and Cameron have shown that conservatism and marriage equality aren’t necessarily incompatible.

The lengthier Scottish consultation process on the same-sex marriage bill included outreach to hear the views of religious groups, and churches will have the right (though not the obligation) to ‘opt in’ to same-sex marriage in Scotland when the law takes effect later this year.  That makes the Scottish same-sex marriage act somewhat stronger than the English version, which provides a blanket ban on same-sex ceremonies within the Church of England.

The first same-sex marriages in England and Wales will take place in March, and the first marriages in Scotland will take place later in autumn 2014.

It also leaves Northern Ireland as the only part of the United Kingdom without same-sex marriage — and as I wrote last summer, don’t expect the Northern Irish assembly at Stormont to take up the cause of LGBT equality anytime soon:  Continue reading Scotland passes same-sex marriage, joining England and Wales

Separatists from Québec to Barcelona will be watching Scotland’s historic vote on independence in the autumn, which could end over three centuries of union between Scotland and England, bringing the United Kingdom as we know it to an end.

Scottish nationalists, buoyed by the economic hopes of North Sea oil, have increasingly floated the idea of independence since the 1970s.  Scotland’s rift with Tory prime minister Margaret Thatcher in the 1980s only alienated the country further from Westminster, and the election of Labour prime minister Tony Blair in 1997 led to the devolution of many Scottish domestic matters to a new regional parliament at Holyrood.  Since 2007, the Scottish government has been led by the Scottish National Party (SNP) and first minister Alex Salmond.  In the most recent May 2011 Scottish elections, the SNP was so popular that it won a majority government — a feat that the Scottish electoral system was specifically designed to avoid.

Salmond and his popular deputy first minister Nicola Sturgeon will lead the ‘Yes’ campaign for Scottish independence following the agreement that Salmond and British prime minister David Cameron struck in March 2013 on the referendum’s date and its terms.  Proponents are likely to paint a vision of Scotland as an independent nation that has more in common with the Nordic welfare states than with Anglo-American capitalism.  Though Scotland’s 5.3 million residents comprise just around 8.4% of the total UK population, Scotland has retained a proud and distinct culture and a discrete linguistic and intellectual tradition, and it veers politically to the left of England.

Cameron, the leader of the center-right Conservative Party, will help lead the ‘No’ campaign, which has already been christened the ‘Better Together’ campaign.  But the relative unpopularity of Cameron and the Tories in Scotland means that he’ll need help from the centrist Liberal Democratic Party and the center-left Labour Party.  In particular, Alistair Darling, the former Labour chancellor of the exchequer under prime minister Gordon Brown (both of whom are Scottish) is chairing the ‘Better Together’ effort.  Although the ‘No’ campaign will try to convince Scots that they are, in fact, better off staying in the United Kingdom, it will also point to obstacles that an independent Scotland could face.  Chief among those obstacles might be Scotland’s position in the European Union — although Scots are generally more pro-EU than their English counterparts, it’s not clear whether an independent Scotland would automatically join the European Union or would be forced to apply for readmission.  Scotland would also face protracted negotiations with England (or perhaps the ‘United Kingdom of England, Wales and Northern Ireland’) over splitting the current UK debt burden, as well as defense, currency, immigration, citizenship and other myriad arrangements.

Polls show that Scottish voters today oppose independence — around 40% to 55% of voters would vote ‘No,’ and just around 25% to 35% would vote ‘Yes.’  But the campaigns won’t hit top speed until later in 2014 after the UK vote to elect members to the European Parliament.

Amid all of the discussion of British prime minister David Cameron’s plan to renegotiate certain opt-outs (on immigration or justice, perhaps) from the rest of the European Union and to hold an ‘in-or-out’ referendum if he wins reelection in May 2015, the question is typically framed as ‘should Britain stay in the European Union?’

But on the basis of 40 years of British membership in the European Union, it seems clearer that the United Kingdom has already left the European Union in a meaningful sense, and even when it entered what was then the European Economic Community, it was never incredibly keen with the concept of ever closer union.

Alternatively, policymakers should concede the reality of British reluctance for more cooperation and frame the question in terms of whether the British should seek an informal separation or a formal divorce:

But as European citizens ponder the consequences of whether the British people will vote to end what’s been a dysfunctional four-decade relationship with the European Union, the question of whether Britain is going to leave the EU has become redundant — Britain, in many ways, has been leaving the Union since virtually the day it became a member.  Accordingly, the real question for British and Europe is whether the British will opt for a separation or for a divorce. We argue that separation, a detailed membership renegotiation, is the better option for both sides rather than a complete exit….

[With] British public opinion increasingly inclined to leave the European Union, it is even more important to frame the question of Britain’s relationship with Europe in realistic terms, however difficult that may be to accept.  While the terms of separation of British association with many core aspects of the European Union may be difficult for European leaders to stomach, it may be the best alternative to a more formal divorce that seems likely to happen if policymakers in London, Brussels and Berlin continue to deny the reality that British-EU relations will never be — and never have been — amorous.

 

 

Cameron loses House of Commons vote on Syria military intervention

The joint US and European will to respond to last Wednesday’s chemical attack on the eastern outskirts of Damascus has received a blow after the British House of Commons voted narrowly 283 to 272 against a resolution that would have provisionally authorized British military intervention in Syria — a staggeringly rare defeat for a British government on a matter of foreign policy.Syria Flag Icon freesyriaUnited Kingdom Flag Icon

The vote comes as a blow not only to UK prime minister David Cameron, who suffered defections from nearly three dozen skeptical Conservatives as well as additional Liberal Democratic members of his own governing coalition, but also interventionists in the United States who are urging US president Barack Obama to launch an aggressive attack on the regime of Syrian president Bashar al-Assad.  It is very unlikely that the United States would proceed with unilateral military action without British support, which is unlikely to come anytime soon in light of Cameron pledge to respect the parliamentary decision:

I can give that assurance. Let me say, the House has not voted for either motion tonight. I strongly believe in the need for a tough response to the use of chemical weapons, but I also believe in respecting the will of this House of Commons. It is very clear tonight that, while the House has not passed a motion, it is clear to me that the British parliament, reflecting the views of the British people, does not want to see British military action. I get that and the government will act accordingly.

It’s a vote that has the potential to turn the US-UK relationship upside down, to turn Middle Eastern realpolitik upside down, to turn British politics upside down and even to turn US politics upside down.  For a sitting prime minister to lose a vote like this is a huge reversal in the relationship between an ever-more powerful British executive and an ever-more feeble parliament on issues like security policy and foreign affairs.

Most immediately, it means that a U.S.-led missile strike, which seemed imminent yesterday, will now be postponed until early next week, at the earliest, when chemical weapons inspectors from the United Nations have had an opportunity to provide their initial assessment of what happened in Ghouta and eastern Damascus.  The vote also comes after several news organizations reported that U.S. and allied intelligence agencies are assured that while the chemical attack came from pro-Assad forces, they are uncertain who ordered the attack amid indications that Assad and his top military brass were caught unaware.  Meanwhile, French president François Hollande has backed off earlier, more urgent calls for military action.

Cameron’s massive defeat does not necessarily preclude a vote next week after the United Nations reports back as to which party — and which chemical agent — is to blame for the horrific Damascus attack.  If the UN report, together with US and European intelligence, all points to Assad’s culpability, Cameron and Obama will have a much stronger case for an aggressive response, either inside or outside the United Nations Security Council.

Meanwhile, the vote is perhaps the largest political victory in Ed Miliband’s three-year tenure as leader of the Labour Party.  Miliband firmly opposed the resolution even after Cameron offered to submit to a second vote before authorizing military action, making today’s resolution essentially a vote for the principle of the British government’s potential military intervention.  The vote capped a tumultuous 24 hours in Westminster, with Cameron’s allies accusing Miliband of giving ‘succour’ to the Assad regime, which probably didn’t make it likelier that Labour would close ranks with the Tories over a potential Syria intervention.  It was a principled stand for Miliband and, though he’s closer to British public opinion on Syria than Cameron, it was also a courageous stand for a young opposition leader to oppose a sitting government on such a crucial matter of foreign policy.

Would a Miliband-led Labour government be an improvement on British civil liberties?

The troubling case of David Miranda, the partner of Guardian reporter Glenn Greenwald, who was detained by British police at Heathrow yesterday for nine hours under schedule 7 of the U.K. Terrorism Act, is now a full-blown fully international incident. United Kingdom Flag Icon

The case has implications not only for U.S. politics (Greenwald has been the chief source for the leaks about the U.S. National Security Agency’s Internet intelligence-gathering programs) and even Brazilian politics (Greenwald lives in Brazil with Miranda, a Brazilian native), but for British politics as well, where the issue of civil liberties has been contentious for the past decade and a half under both the Labour governments of Tony Blair and Gordon Brown and the Conservative-led government of current prime minister David Cameron.

Political strategist Ian Bremmer is already suggesting that the United States and/or the United Kingdom may be preparing an indictment against Greenwald (presumably under the U.S. Espionage Act), which would explain why Miranda’s laptop computer and other personal effects were confiscated in London.  We already know that the United States, by the admission of White House deputy press secretary Josh Earnest was given a heads-up by London prior to Miranda’s detention, though Earnest has denied that the United States requested or collaborated with the detention.  It’s equally plausible that overeager police officials in London jumped at an opportunity to gather information they thought top U.S. and U.K. officials would appreciate — if the United States and the United Kingdom really are pursuing an international case against Greenwald, you’d think they would be careful not to commit what seems like a prima facie violation of the U.K. Terrorism Act.

With both Scotland Yard and Cameron saying little about the incident, and with U.S. officials remaining relatively mum, most of today’s discussion has been dominated by vehement critics of the detention on both sides of the Atlantic.

One of the most striking has come from Labour Party’s shadow home secretary, Yvette Cooper, a rising Labour star who may herself one day lead the party, who has called for an investigation into whether the detention was appropriate under the Terrorism Act:

Schedule 7, which applies only at airports, ports and border areas, controversially allows officers to stop, search, question and detain individuals. Miranda was held for nine hours, the maximum the law allows before officers must release or formally arrest the individual.

According to official figures, most examinations under schedule 7 – over 97% – last less than an hour, and only one in 2,000 people detained are kept for more than six hours. It has been widely criticised for giving police broad powers under the guise of anti-terror legislation to stop and search individuals without prior authorisation or reasonable suspicion – setting it apart from other police powers.

As we approach the annual convention period in British politics, pressure on Labour leader Ed Miliband is growing to draw a deeper contrast with the current coalition government on many issues, including civil liberties.  Soon after his election as Labour leader in September 2010, Miliband criticized his party’s overreach on civil liberties, identifying in particular the Blair government’s plan to hold suspects for 90 days without trial and the broad use of anti-terrorism laws.  At the time, Miliband argued that he wanted to lead Labour to reclaim the British tradition of liberty, though Miliband also indicated at the time he supported Blair’s widespread introduction of what are now over 4 million closed-circuit television surveillance cameras throughout the country.

As the parties begin to jostle for position for an election that’s now just 21 months away, Cameron certainly won’t be able to run for reelection on as vigorous a pro-liberty position as he did in 2010, though his junior coalition partners, the Liberal Democrats, can point to their success in repealing Labour’s plan to introduce national ID cards and scrapping the Tories’ proposed communications data bill this year.

That leaves a key opening for Miliband to champion civil liberties, but given the durability of the British surveillance state and Labour’s role in creating the legal framework last decade for the British surveillance state, it is unclear whether Miliband will do so, though Cooper delivered a high-profile speech in July arguing for more oversight and protections in relation to the U.K. intelligence and security services.  It’s likelier, however, that a future Labour government will pursue many of the same pro-security policies that each of the Blair, Brown and Cameron governments have pursued.

Clarke’s British reform failures a lesson as Holder pushes for historic turn on U.S. crime

As U.S. attorney general Eric Holder makes a serious push for prison and justice reform in the United States, he would do well to look at a similar push across the Atlantic — Kenneth Clarke’s attempt to reverse decades of tough criminal law policies in the United Kingdom provides a cautionary tale.USflagUnited Kingdom Flag Icon

Holder announced yesterday in a speech to the American Bar Association that the U.S. justice department will seek to avoid mandatory sentences for non-violent, low-level drug-related offenses, and justice reform advocates largely cheered a welcome pivot from the ‘tough-on-crime’ approach to justice that’s marked U.S. policy for the past four decades throughout much of the ‘War on Drugs’ — drug-related offenses have largely fueled the explosion in the U.S. prison population.  Holder will instruct prosecutors in federal cases not to list the amount of drugs in indictments for such non-violent drug offenses, thereby evading the mandatory sentences judges would otherwise be forced to administer under federal sentencing guidelines.  That’s only a small number of prisoners because 86% of the U.S. prison population is incarcerated by state government and not by the federal government.

Holder called for ‘sweeping, systemic changes’ to the American justice system yesterday and attacked mandatory minimum sentences for non-violent offenders, which he said caused ‘too many Americans go to too many prisons for far too long and for no good law enforcement reason.’

That approach has left the United States with a prison population of nearly 2.5 million people (though the absolute number has declined slightly after peaking in 2008) and the world’s highest incarceration rate of 716 prisoners per 100,000 .  That’s more than Russia (484), Brazil (274) the People’s Republic of China (170) or England and Wales (148) and as Holder noted yesterday, the United States has 5% of the world’s population but 25% of the world’s prisoners.

Particularly damning to the United States is that 39.4% of all U.S. inmates are black and 20.6% are Latino, despite the fact that black Americans comprise just 13% of the U.S. population and Latinos comprise just 16%.  Holder yesterday cited a report showing that black convicts receive prison sentences that are around 20% longer than white convicts who commit the same crime.  Holder denounced mandatory minimums as ‘draconian,’ and made an eloquent case that U.S. enforcement priorities have had ‘a destabilizing effect on particular communities, largely poor and of color,’ that have been counterproductive in many cases.  Holder also made that case that in an era of budget cuts, America’s incarceration rate is a financial burden of up to $80 billion a year, and that reducing the U.S. prisoner population could shore up the country’s finances as well.

But Holder — and prison reform advocates that have emerged on both the American left and right — face a heavy task in reversing nearly a half-century of crime legislation that has largely ratcheted up, not down.

Just ask Kenneth Clarke, who until last September was the justice minister in UK prime minister David Cameron’s coalition government, who as one of the longest-serving and most effective Tories in government for the past four decades, faced a tough road in enacting prison reform in England and Wales.

Though its prison population and incarceration rate pales in comparison to that of the United States, the British justice system imprisons more offenders than many other countries in the European Union, such as France (101 prisoners per 100,000) or Germany (80).

Cameron faced a delicate task in finding a role for Clarke in his government back in mid-2010.  Clarke, a self-proclaimed ‘big beast’ of Tory politics got his start under ‘one nation Tory’ prime minister Edward Heath and found his stride under Heath’s successor, Margaret Thatcher.  He became John Major’s chancellor of the exchequer, guiding No. 11 from the dark days of the 1992 ‘Black Wednesday’ sterling crisis to a more robust financial position.  When Labour swept to power in May 1997 under Tony Blair, Clarke immediately became the most popular Conservative in the country, even though the significantly more right-wing and increasingly euroskpetic party thrice denied the pro-Europe Clarke its leadership.  While Clarke may have passed his glory days in government, his appointment as justice minister reflected that Clarke could still be useful in government.

Are constitutional monarchies better than presidential republics? Correlation ≠ causation!

Like most folks who have no really strong feelings about the British monarchy (I’m neither incredibly pro-monarchy or anti-monarchy as far as constitutional monarchies go these days), I spent much of the past two days avoiding the coverage surrounding the birth of the royal prince born Monday to Prince William and Kate Middleton. United Kingdom Flag Icon

But Dylan Matthews, over at The Washington Post‘s Wonkblog, used the opportunity of the young (as yet unnamed) prince’s birth to make the case that constitutional monarchies are preferable to republics with elected heads of states, and that is a question in which that Suffragio readers ought to be incredibly interested.  It’s a piece I read with keen excitement, it makes some very smart points, and it makes this rather sweeping conclusion:

Constitutional monarchy is the best form of government that humanity has yet tried. It has yielded rich, healthy nations whose regime transitions are almost always due to elections and whose heads of state are capable of being truly apolitical. The U.S. would do well to adopt it.

The punchline is that a constitutional monarchy is preferable to a republic with an elected, ceremonial head of state.  That’s because a monarch’s position is not rooted in any legitimate political process, unlike a president who is elected either directly by ballot or indirectly by a national parliament — when political crises arise, a monarch is less likely to intervene in political affairs, thereby resulting in new elections; in contrast, an elected president is more likely to engineer a new government without new elections:

The key to monarchs’ success is that they’re totally illegitimate. The people wouldn’t stand for Queen Elizabeth exercising real political power just because of who her father was. That’s a powerful deterrent that prevents monarchs from meddling in political affairs. The result is that in all but very rare cases, prime ministers in monarchies are never thrown out of office except when they call elections or when they receive a vote of no confidence in parliament. The head of state can’t touch them.

It’s an interesting thesis, but I’m not sure that it holds up nearly as well as Matthews thinks it does.

He begins with what I believe is the weakest argument of all — that constitutional monarchies are healthier and richer than other republics, and he presents a graph that purports to show that, on average, constitutional monarchies are richer and healthier (see below the chart from Wonkblog):

But of course, ‘correlation does not equal causation.’

 

There are a lot of historical and economic reasons that explain why constitutional monarchies, which are predominantly located in Europe, are so much richer and healthier.  North America and Europe are, well, richer than Africa or the Middle East or South America, in general terms, but it seems like ‘having a constitutional monarchy’ is not incredibly high on the list of reasons why Europe’s standard of living is so much higher than Africa’s.  The legacy of colonialism, for one.

After making this correlation, Matthews then backs off the claim somewhat:

Of course, this doesn’t demonstrate that having a constitutional monarchy makes countries richer, only that it’s totally possible to both be a healthy, rich country and be a constitutional monarchy. The practice is hardly a “grotesque relic.”

Still, the chart that states ‘constitutional monarchies are richer and healthier’ is not subtle, and I’m sure Matthews doesn’t mean to argue that Nicaragua or Paraguay or Kyrgyzstan would today have a GDP per capita of $40,000 if only they had introduced monarchies a century ago.  Nor do I believe Matthews would defend the absolute monarchy of Swaziland, which boasts the world’s highest HIV/AIDS rate and where GDP per capita routinely falls even below that of neighboring South Africa.  Is Swaziland better off today from the benevolence of  King Mswati III?  I don’t find that argument credible.

Thereupon, Matthews points to countries like Germany, Italy, Israel, Ireland, and India, which all have elected, mostly ceremonial, presidents:

Opponents of constitutional monarchy often point to this as their preferred alternative. The British group Republic supports abolishing the monarchy and replacing it with a directly elected president, and estimates that the British royal family costs almost ten times as much as the German president. So why not just do that, then?

But that sets up a false equivalency — at one point, Matthews writes, ‘ If Britain chose to depose its divinely ordained rulers, it’d still need a head of state.’

And that’s just not true.  There’s no theorem of international relations that requires a parliamentary system to have a separate head of state.  Matthews notes that only the sultans of Brunei and Oman simultaneously serve as prime minister.  But in the United States, the president also essentially serves as the simultaneous head of state and head of government (unless you’d like to argue that John Boehner, speaker of the U.S. House of Representatives, or Harry Reid, the U.S. Senate majority leader, are the heads of government, though I think it would be a difficult argument).  In any event, even if we don’t particularly prefer the Bruneian or Omanese models, it doesn’t mean that it’s a bad model from an abstract governance standpoint.

The only rationale in favor of having a ceremonial head of state is for purposes of national unity.  In Spain, for example, the return of Juan Carlos I was an important step in the transition from the Franco dictatorship to robust democratic Spanish state we recognize today.  But that example isn’t theoretical, it’s grounded in time and place to specific historical events, and it doesn’t provide a rationale for any other European monarch or ceremonial president, least of all in the United Kingdom.  The existence of the British monarchy hasn’t stopped the push for devolution and even independence in Scotland, for example, and there’s no reason to believe an elected president would make any difference.  Continue reading Are constitutional monarchies better than presidential republics? Hey! What about gay marriage in Scotland and Northern Ireland?

Amid the fanfare that much of the United Kingdom would now enjoy full same-sex marriage rights following the success of Conservative UK prime minister David Cameron in enacting a successful vote earlier this week in Parliament, some LGBT activists are still waiting at the altar of public policy for their respective day of celebration.United Kingdom Flag Iconscotlandnorthernireland

Under the odd devolved system within the United Kingdom of Northern Ireland and Great Britain, it’s up to the separate Northern Ireland Assembly to effect its own laws on marriage.  Even within Great Britain, the Scottish parliament, likewise, has the sole power to enact legislation related to marriage rights.

So while nearly 90% of the residents of the country will now be able to enter into same-sex marriages, Scottish and the Northern Irish will have to wait a little longer — and in the case of Northern Ireland, it seems like the wait will be lengthy. Scotland, with 5.3 million people (8.4% of the total UK population), and which will vote on independence in a referendum in September 2014, is already taking steps toward passing legislation, though Northern Ireland, with 1.8 million people (2.9% of the UK population), has already considered and rejected same-sex marriage.

The reason for the disparity within the United Kingdom goes back to former Labour prime minister Tony Blair.

Under the broad devolution process that his ‘New Labour’ government initiated upon taking power in 1997, much of the power to regulate life in Scotland was devolved from Westminster to the new parliament that met for the first time in 1999 at Holyrood.  Although a parallel Welsh Assembly exists in Cardiff for Welsh affairs, the Welsh parliament lacks the same breadth of powers that the Scottish parliament enjoys, which is why the Welsh now have same-sex marriage rights. (Take heart, Daffyd!)

Northern Ireland has a similar arrangement, with its own devolved Northern Ireland Assembly at Stormont, though its powers were suspended from 2002 to 2007 when the Northern Ireland peace process fell apart, however briefly.

The disparate courses of English, Scottish and Northern Irish marriage rights are a case study in how devolution works in the United Kingdom today.

Scotland: Holyrood poised to pass an even stronger marriage equality bill in 2014

Scotland’s local government, led by Alex Salmond and the Scottish National Party, introduced a same-sex marriage bill late in June that is set to provide an even more liberal regime of marriage rights.  While the marriage bill passed earlier this week in London actually bans the Anglican Church of England from offering same-sex marriage ceremonies, the Scottish bill won’t have the same prohibitions on the Presbyterian Church of Scotland, which is seen as somewhat more relaxed about gay marriage.  Like the English legislation, however, the Scottish bill offer protections to ministers on religious grounds who do not choose to officiate same-sex marriages.

Although there’s opposition to the bill within the governing SNP as well as the Scottish Labour Party and the Scottish Liberal Democratic Party, the Conservative Party has very little influence outside England and Scotland, generally speaking, is even more socially progressive than England, which means that the legislation is widely expect to pass in the Scottish Parliament early next year, with the first same-sex marriages in Scotland to take place in 2015.

Northern Ireland: gay marriage as a football between Protestant and Catholic communities

Earlier this year, the Northern Ireland Assembly considered a same-sex marriage bill, but it was defeated in April by a vote of 53 to 42 — a similar motion was defeated in October 2012 by a similar margin. Since 2005, LGBT individuals have been able to enter into civil partnerships (with most, though not all, of the rights of marriage enjoyed by opposite-sex partners) throughout the entire United Kingdom, including Northern Ireland.

When Scotland passes its gay marriage bill next year, however, it will leave Northern Ireland as the only part of the United Kingdom without marriage equality.

Not surprisingly, given that Northern Ireland was partitioned out of the Republic of Ireland in 1921 largely on religious lines, and Protestant-Catholic violence has plagued Northern Ireland for much of the decades since, Northern Ireland is the most religious part of the United Kingdom.  A 2007 poll showed that while only 14% of the English and 18% of Scots were weekly churchgoers, fully 45% of the Northern Irish attended church weekly.

Unlike Scotland, where the mainstream UK political parties, such as the Tories, Labour and Liberal Democrats, aim to compete with the Scottish Nationalists (with varying degrees of success), Northern Irish politics are entirely different, based instead on the largely Protestant ‘unionist’ community and the largely Catholic ‘nationalist’ community.  Around 41% of Northern Ireland is Roman Catholic, while around 41.5% of Northern Ireland is Protestant (mostly the Presbyterian Church and the Anglican Church of Ireland).

That helps explain why the opposition to gay marriage in Northern Ireland remains so strong, and it doesn’t help that the issue falls along the same lines as the entrenched unionist and nationalist divisions.  Given that it’s unlikely either community will come to dominate Northern Irish politics and the Assembly anytime soon, it means that proponents of same-sex marriage will have to convince at least some unionists to join forces with largely supportive nationalist parties to pass a marriage bill — and that may prove a difficult task for a five-way power-sharing government in Belfast that has enough difficulties even without gay marriage.  Continue reading Hey! A tale of two referenda: How the EU debate could poison the Scotland debate

In a static world, it’s easy to believe that UK prime minister David Cameron’s call in January 2013 for a referendum on the United Kingdom’s continued membership in the European Union will never come to pass — it depends upon the reelection of a Conservative-led in the 2015 general election, Cameron’s continued Tory leadership and a lengthy process of negotiation thereafter with EU leaders. United Kingdom Flag Iconscotland

So when Cameron agreed with Scottish first minister Alex Salmond two months later to hold a referendum on Scottish independence in September 2014, he had every reason to believe that he had bought enough time to keep the European issue relatively calm.  After all, poll after poll shows the pro-independence vote lagging far behind the anti-independence vote and, despite a relatively large number of undecided Scottish voters, many polls throughout 2012 and early 2013 showed the ‘no’ vote with over 50% support.  One Ipsos poll earlier this month showed that 59% support union and just 31% support independence.

But what’s increasingly clear is that the two referenda are becoming inseparable — Scotland’s future role in the United Kingdom depends on the United Kingdom’s future role in Europe.  With Westminster now increasingly turning to its toxic obsession with its union with Europe, a group of largely English parliamentarians may well be endangering the more longstanding three-century union with Scotland.

It’s easy to follow Cameron’s arithmetic here:  Allow the United Kingdom Independence Party (UKIP) and the more euroskeptic members of his own party their opportunity for an anti-Europe outlet in the May 2014 European Parliament elections.  Then sail through the September 2014 Scottish referendum with both the Labour Party and the Liberal Democratic Party united against Scottish independence, maybe even by promising ‘devomax,’ a form of further devolution of tax and spending powers to the Scottish parliament that came into existence in 1999.  Cameron could therefore put the specter of Scottish independence behind him before looking to the next general election and, if successfully reelected, the EU negotiations that would precede the long-promised EU referendum.

What Cameron didn’t count on was the growing chorus of euroskeptic rage from within his own party, which seems destined to repeat the Tory infighting of the 1990s that so destabilized former prime minister John Major’s government  Education minister Michael Gove’s insisted last week, for example, that he would support leaving the European Union if a vote were held immediately.  Over 100 Tory backbenchers are calling for a law to guarantee a referendum later this decade or even for a referendum before 2015, and one Tory MP is even arguing for a full joint Tory/UKIP electoral coalition in 2015.  Some Tories are even trying to look beyond Cameron to a more Euroskeptic leader, perhaps even Gove.  It comes at a time when UK voters insist in poll after poll that they would overwhelmingly vote to leave the European Union in a referendum.

UKIP’s rise hasn’t helped, and Nigel Farage’s insistence at contesting a Scottish by-election led to the somewhat humorous result of his being chased out of a pub in Edinburgh last week (pictured above).  Though it’s a safe bet that Farage and UKIP won’t make many inroads in Scotland, it’s hard to see how his active presence in Scotland could do anything but make things worse for unionist supporters.  His party is currently polling as much as 20% in national polls, outpacing the Liberal Democrats and, in some cases, pulling to within single digits of the Conservatives (giving Labour a sizable lead).  Even if Labour wins in 2015, if UKIP wins the support of one out of every five UK voters, it will pull not only the Tories, but probably even Labour, further toward euroskepticism and eventual rupture with Europe.  Continue reading A tale of two referenda: How the EU debate could poison the Scotland debate

What Iceland’s election tells us about post-crisis European politics

In allowing its banks to fail, neo-Keynesian economists have argued, Iceland avoided the fate of Ireland, which nationalized its banks and now faces a future with a very large public debt.  By devaluing its currency, the krónur, Iceland avoided the fate of countries like Estonia and others in southern Europe trapped in the eurozone and a one-size-fits all monetary policy, allowing for a rapid return to economic growth and rapidly falling unemployment.  Neoclassical economists counter that Iceland’s currency controls mean that it’s still essentially shut out from foreign investment, and the accompanying inflation has eroded many of the gains of Iceland’s return to GDP growth and, besides, Iceland’s households are still struggling under mortgage and other debt instruments that are linked to inflation or denominated in foreign currencies.

But Iceland’s weekend parliamentary election shows that both schools of economic thought are right.

Elections are rarely won on the slogan, ‘it could have been worse.’ Just ask U.S. president Barack Obama, whose efforts to implement $800 billion in stimulus programs in his first term in office went barely mentioned in his 2012 reelection campaign.

Iceland, as it turns out, is hardly so different at all — and it’s now virtually a case study in an electoral pattern that’s become increasingly pronounced in Europe that began when the 2008 global financial crisis took hold, through the 2010 sovereign debt crisis in the eurozone and through the current European-wide recession that’s seen unemployment rise to the sharpest levels in decades.

Call it the European three-step.

In the first step, a center-right government, like the one led by Sjálfstæðisflokkurinn (Independence Party) in Iceland in 2008, took the blame for the initial crisis.

In the second step, a center-left government, like the one led by Jóhanna Sigurðardóttir and the Samfylkingin (Social Democratic Alliance) in Iceland, replaced it, only to find that it would be forced to implement harsh austerity measures, including budget cuts, tax increases and, in Iceland’s case, even more extreme measures, such as currency controls and inflation-inducing devaluations.  That leads to further voter disenchantment, now with the center-left.

The third step is the return of the initial center-right party (or parties) to power, as the Independence Party and their traditional allies, the Framsóknarflokkurinn (Progressive Party) will do following Iceland’s latest election, at the expense of the more newly discredited center-left.  In addition, with both the mainstream center-left and center-right now associated with economic pain, there’s increasing support for new parties, some of them merely protest vehicles and others sometimes more radical, on both the left and the right.  In Iceland, that means that two new parties, Björt framtíð (Bright Future) and the Píratar (Pirate Party of Iceland) will now hold one-seventh of the seats in Iceland’s Alþingi.

This is essentially what happened last year in Greece, too.  Greece Flag IconIn the first step, Kostas Karamanlis and the center-right New Democracy (Νέα Δημοκρατία) initially took the blame for the initial financial crisis.  In the second step, George Papandreou and the center-left PASOK (Panhellenic Socialist Movement – Πανελλήνιο Σοσιαλιστικό Κίνημα) overwhelming won the October 2009 elections, only to find itself forced to accept a bailout deal with the European Commission, the European Central Bank and the International Monetary Fund.  In the third step, after two grueling rounds of election, Antonis Samaras and New Democracy returned to power in June 2012.

By that time, however, PASOK was so compromised that it was essentially forced into a minor subsidiary role supporting Samaras’s center-right, pro-bailout government.  A more radical leftist force, SYRIZA (the Coalition of the Radical Left — Συνασπισμός Ριζοσπαστικής Αριστεράς), led by the young, charismatic Alexis Tsipras, now vies for the lead routinely in polls, and on the far right, the noxious neo-nazi Golden Dawn (Χρυσή Αυγή) now attracts a small, but significant enough portion of the Greek electorate to put it in third place.

The process seems well under way in other countries, too.  In France, for examFrance Flag Iconple, center-right president Nicolas Sarkozy lost reelection in May 2012 amid great hopes for the incoming Parti socialiste (PS, Socialist Party) administration of François Hollande, but his popularity is sinking to ever lower levels as France trudges through its own austerity, and polls show Sarkozy would now lead Hollande if another presidential election were held today.

It’s not just right-left-right, though. The European three-step comes in a different flavor, too: left-right-left, and you can spot the trend in country after country across Europe — richer and poorer, western and eastern, northern and southern. Margaret Thatcher has died

We all woke up in the United States this morning to the news that Margaret Thatcher, the former prime minister of the United Kingdom, died at age 87.United Kingdom Flag Icon

There’s not much I can add (Andrew Sparrow’s live blog at The Guardian is a good place to start) to what will certainly be a week’s worth of paeans to someone who was undoubtedly the most consequential British prime minister since Winston Churchill — and, serving fully 11 years from 1979 to 1990, the United Kingdom’s longest-serving prime minister in the 20th century.

As Peter Hennessy wrote in The Prime Minister: The Office and its Holders since 1945, Thatcher was a ubiquitous presence rivaling Churchill or David Lloyd George:

Friends in the Health Service told me that by the mid 1980s, psychiatrists engaged in the early diagnosis of their more disturbed patients ceased asking them for their own names and birth dates and so on, and asked instead for the name of the prime minister.  If patients failed to remember that, they knew they were properly sunk.

You’ll hear over the next 48 hours the extent to which Thatcher changed Great Britain, Europe and the world, but most immediately, it’s remarkable the extent to which she changed the Conservative Party.  Her influence still lives on today in Tory prime minister David Cameron’s government in the same way that Ronald Reagan’s ghost hovers the Republican Party, even today, in the United States.

It’s not just that she was a woman in a party of old men — German chancellor Angela Merkel won’t likely go down in history in the same breath as Thatcher.

It’s not just that she came from a humble background in a party of aristocracy — her predecessor Edward Heath came from an even more humble background.

It’s that she in many ways was the first truly conservative prime minister of Great Britain, in that her free market fervor really represented a radical departure from the paternal ‘One Nation Tory’ stance of her predecessors.  It’s easy today to forget just how truly broken the UK economy had become in the late 1970s under Labour — strikes, inflation, economic malaise, rubbish uncollected in the streets.  But she inherited a Britain that had reached a post-war nadir, and that turned around in her time in office.

She so transformed British politics that Labour prime minister Tony Blair, when he came to power in the landslide 1997 election, was essentially a Thatcherite — he not only pulled the Labour Party (‘New Labour’) far from its trade union roots, but he arguably pulled it to the right of the Old Tories under Heath and Macmillan.

Even still, it’s amazing the extent to which party grandees — not just Heath, but former prime minister Harold Macmillan in particular — held a special disdain for her, and Hennessy provides in his book even more salacious details on Macmillan’s visit to advise Thatcher in 1982 in advance of her decision to send the British Navy to liberate the Falklands Islands from an Argentine occupation:

Macmillan did not care for Mrs. Thatcher or her style of government.  Seven years earlier, shortly after she had become Leader of the Opposition, he told me, ‘You couldn’t imagine a woman as Prime Minister if we were a first-class power.’

On that April day in 1982, he shuffled in ‘doing his old man act,’ and gazed around the room he had come to know so well between 1957 and 1963.  It was unusually empty.  Mrs. Thatcher was due to see a group of her backbenchers that evening and space had been made ready.  ‘Where’s all the furniture?’ said the old statesman to the new.  ‘You’ve sold it all off, I suppose.’

With colleagues like those, it’s easy to see how Thatcher came to relish confrontation with not only the old-guard Tories, but Labour, and then an entire world full of adversaries from Jacques Delors to the Soviet leadership.  While that confrontational attitude sometimes misfired, both at home (the unpopularity of the poll tax and her anti-European sentiment led Tories to pull the plug on her premiership) and abroad (her oddly Germanophobic opposition to Helmut Kohl’s reunification of West and East Germany), her 11-year tenure really did transform the United Kingdom and Europe:

The essence of Thatcherism was to oppose the status quo and bet on freedom—odd, since as a prim control freak, she was in some ways the embodiment of conservatism. She thought nations could become great only if individuals were set free. Her struggles had a theme: the right of individuals to run their own lives, as free as possible from the micromanagement of the state.

A bad day for Boris — London’s mayor called ‘nasty piece of work’ in interview

Boris Johnson, reelected last year as London’s major and often discussed as a potential Tory successor to prime minister David Cameron, had a very bad weekend.United Kingdom Flag Icon

In an interview with the BBC’s Eddie Mair, Johnson hemmed and hawed over whether he once invented a quote 30 years ago as a young news reporter, lied to former Conservative leader Michael Howard over an affair and a controversial phone conversation from 1990 between Johnson and a friend who wanted to, perhaps, assault a journalist (the journalist was never assaulted, though), each of which are revelations to be discussed in an upcoming documentary about Johnson’s life.

The interview culminates with Mair asking, ‘you’re a nasty piece of work, aren’t you?’

Mair finishes the interview challenging Johnson’s integrity even further for refusing to answer whether he wants to be prime minister one day.

I’m not sure that the questions were entirely relevant to Johnson’s role today as a two-term mayor of London, but it was nonetheless painful to watch Johnson dissemble throughout the interview, especially given the easy manner that ‘Boris’ generally has in public, which was clearly on display during the 2012 summer Olympics.

I’ve seen bad interviews before, and this is about as bad as the infamous Roger Mudd interview with the late U.S. senator Ted Kennedy in 1979 when Kennedy couldn’t give a compelling answer as to why he wanted to be president (Kennedy was challenging U.S. president Jimmy Carter at the time for the Democratic Party’s nomination).

The interview doesn’t necessarily end his chances to become prime minister one day, and it may well backfire on Mair, but it will also certainly renew and reinforce existing doubts about the London mayor’s discipline and his image — it’s the downside to the boyish, off-the-cuff charm that has made him such a noteworthy foil to the more dour Cameron and his chancellor of the exchequer, George Osborne.

Scotland sets a referendum date: September 18, 2014

Scotland’s first minister, Alex Salmond, has set September 18, 2014 as the date for the referendum on potential Scottish independence.United Kingdom Flag Iconscotland

Polls have been relatively consistent, with support for independence at around 30% to 35% and with support for continued union with England at around 50% to 55%.

But the up-or-down vote will come in 18 months, and a lot can obviously change in 18 months, including the popularity of Salmond (pictured above) and his Scottish National Party, which won in 2011 the first majority government since devolution in the late 1990s.

Three quick things to keep an eye on:

Shetland and Orkney.  Shetland and Orkney, the groups of islands to the northeast of Scotland, could well stay within the United Kingdom if Scotland leaves.  That would complicate the Scottish economic rationale for independence, dependent as it is upon North Sea oil revenues.  It’s no surprise then, to see Liberal Democrats encouraging Shetland and Orkney to think of themselves as a unit within the United Kingdom than as just an appendage of Scotland.

Tory incentives. As Liberal Democratic deputy prime minister Nick Clegg has sharply noted, Conservatives do not have an incredible incentive to fight hard to keep Scotland in the United Kingdom, given that they hold one seat.  It’s fair to worry that Tories actually have an electoral incentive to see an independent Scotland — though, because the Scots are just 8.5% of the UK population, it’s not as much as you might think.  Labour prime minister Tony Blair’s massive 12-point 1997 landslide was still a massive 10-point landslide within England proper.  In the 2010 general election, Labour won 28.1% in England and 29.0% nationwide, while the Tories won 39.6% in England and just 36.1% nationwide.  So it’s a boost, but not a gigantic one.

Europe.  Also, there’s some dicey choreography with the European Union too, because as the United Kingdom approaches prime minister David Cameron’s promised 2017 referendum on potentially leaving the EU, the more it could have a negative effect on the Scotland effort.  In fact, even with sluggish growth in the next 18 months, I think the anti-Europe tone in England is the biggest threat to the anti-independent forces in very much pro-Europe Scotland.  If Nigel Farage’s United Kingdom Independence Party (UKIP) continues to make further gains in advance of the 2015 general election, it could well scare some of the pro-union, pro-European Scots toward the independence camp.

Despite what anyone in Brussels or Berlin or London or Edinburgh says, no one thinks that Scottish independence would leave it outside the EU for long.  Given that the Scots have implemented as much of the acquis communautaire as England has, it’s certain that the Scots would align independence with simultaneous Scottish accession to the EU.  That’s a non-issue.

Does Argentina have a case in its fight for the Falklands/Malvinas?

On Sunday and Monday, 1,517 eligible voters in the Falkland Islands (or, if you like, las Islas Malvinas) turned out to vote in the referendum on its status as an overseas territory of the United Kingdom.falklands flagUnited Kingdom Flag Iconargentina

Fully 1,513 voters supported the current status, and three voters disagreed.

That should be an open-and-shut-case, right?  Certainly under any principles of self-determination, a 99.74% victory for remaining under the aegis of the United Kingdom should be respected — the residents of the small islands that the United Kingdom (and the residents themselves) call the Falklands Islands and that Argentina call the Islas Malvinas, which lie just 310 miles off the coat of Argentine Patagonia (and over 8,000 miles from London).

Not so fast.

The dispute goes back to 1833 — and really, even further:

  • To the 1520s, when Argentines claims that Ferdinand Magellan discovered them on behalf of Spain.
  • To 1690, when the British say that captain John Strong first landed on the islands, naming them for Viscount Falkand.
  • To 1764, when both sides agree that France settled Port Louis, though the Argentine and British stories vary as to what happened next — a British expedition certainly arrived in 1765 but had left, however, by 1774.

By 1833, the British were back — it’s essentially pretty clear that UK settlers took control of the islands in that year, and that those settlers and their descendants have remained there continuously ever since.  But Argentina argues that it inherited the Spanish claim to the islands when it won independence.  It’s unclear whether Argentina’s then-ruler, Juan Manuel de Rosas, in 1850, as part of the negotiations for the Arana-Southern Treaty between the United Kingdom and Argentina, conceded the claim to the British. Maybe he did. Maybe not. It’s not formally a part of the treaty.

Of course, settlers in North America rebelled against UK colonial rule to great effect — and independence — in 1776.  But the claim here is different — and messier.

The UK-Argentine tussle only became more of an international tussle on Wednesday with the election of Jorge Mario Bergoglio, the archbishop of Buenos Aires as the new Catholic pope, Francis, who has asserted the Argentine claim to the islands. (For his part, monsignor Michael McMarcam the head of the Catholic Church on the islands, says the new pontiff is welcome in the Falklands/Malvinas).

Think of it this way: in a parallel world, imagine that the indigenous and Spanish settlers of Florida managed to withstand American invasion in the 1820s and form their own country.  Within a decade, the United States (or, if you’d like, the United Kingdom) took control of the Florida Keys and, despite their proximity to Florida (remember, it’s not a U.S. state but rather a sovereign nation in our parallel universe), formed settlements.  For generations, the US/UK and their Keys settlers and descendants held sufficient power to develop and deepen those settlements.  Is it necessarily an easy case, even 180 years later?  (Would your opinion change if you were Indian? Irish? Residents of Diego Garcia, the emptied British naval base in the Indian Ocean?)

The Argentine government argues that principles of self-determination don’t apply in the case of the Falklands/Malvinas, because the original generation of occupiers usurped the islands from Argentina, which was still in the growing pains of asserting its own independence.  But that was 180 years ago, and generations of Falkands settlers have called the islands their home ever since.  Is there a statute of limitations on such post-colonial claims?

For their part, Falklands settlers aren’t convinced:

I would like to know under what legislation the Argentine government calls it illegal. We approved it under our own laws here at the Falklands (Malvinas) and I was told that there is a meeting in the Argentine Congress on Wednesday to discuss its rejection. For a referendum that is illegal and for voters that don’t exist, they appear to be paying it a lot of attention.

The islands were the site of an infamous 1982 war between the United Kingdom (then under the leadership of prime minister Margaret Thatcher) and Argentina (then in the final years of Argentina’s last military junta that took power in 1976 and prosecuted the ‘Dirty War,’ in 1982 under the leadership of Leopoldo Galtieri).  Galtieri ordered an invasion of the islands in April 1982 (the joke is after one bottle of whiskey too many), hoping that his newly confirmed cold warrior bona fides from U.S. president Ronald Reagan would forestall a military response from the United Kingdom.

Should David Cameron change course over the UK budget?

The United Kingdom is closer to May 2015 than it is to May 2010, which is to say that it’s closer to the next general election than to the previous one.United Kingdom Flag Icon

With the announcement of the 2013 budget coming later this month, likely to be very controversial if it features, as expected, ever more aggressive expenditure cuts, what does UK prime minister David Cameron have to show for his government’s efforts?

The prevailing conventional wisdom today is that Cameron and his chancellor of the exchequer George Osborne (pictured above) have pushed blindly forward with budget cuts at the sake of economic growth by reducing government expenditures at a time when the global economic slump — and an even deeper economic malaise on continental Europe — have left the UK economy battered.  If you look at British GDP growth during the Cameron years (see below — the Labour government years are red, the Cameron years blue), it’s hard to deny that it’s sputtering:

One way to look at the chart above is that following the 2008 global financial panic, the United Kingdom was recovering just fine under the leadership of Labour prime minister Gordon Brown, and that the election of the Tory-led coalition and its resulting budget cuts have taken the steam out of what was a modest, if steady, economic recovery.  Those cuts have hastened further financial insecurity in the United Kingdom, critics charge, and you need look no further than Moody’s downgrade of the UK’s credit rating last month from from ‘AAA’ to ‘AA+’ for the first time since 1978.

An equally compelling response is that British revenues were always bound to fall, given the outsized effect of banking profits on the UK economy, and that meant that expenditure corrections were inevitable in order to bring the budget out from double-digit deficit.  In any event, 13 years of Labour government left the budget with plenty of fat to trim from welfare spending.  Despite the downgraded credit rating, the 10-year British debt features a relatively low yield of around 2% (a little lower than France’s and a bit higher than Germany’s), and we talk about the United Kingdom in the same way we talk about the Netherlands, Belgium and Germany — not the way we talk about Iceland, Ireland, Spain, Italy or Greece.  Given the large role the finance plays in the British economy, it wasn’t preordained that the United Kingdom would be more like France than, say, Ireland.

Nonetheless, polls show Cameron’s Conservative Party well behind the Labour Party in advance of the next election by around 10%, making Labour under the leadership of Ed Miliband and shadow chancellor Ed Balls, a Brown protégé, implausibly more popular than at any time since before former prime minister Tony Blair’s popularity tanked over the Iraq war.  Despite Cameron’s ‘modernization’ campaign, which notched its first notable triumph with the recognition of same-sex marriage in February, over the howls of some of his more old-fashioned Tory colleagues, he remains deeply unpopular.

Meanwhile, the upstart and nakedly anti-Europe United Kingdom Independence Party — Cameron famously once called them a bunch of ‘fruitcases, loonies and closet racists’ — has grown to the point that it now outpolls Cameron’s governing coalition partners, the Liberal Democratic Party. UKIP even edged out the Tories in a recent by-election in Eastleigh, and Cameron has relented to calls for the first-ever referendum on the continued UK membership in the European Union (though, targeted as it is for 2017, it assumes that Cameron will actually be in power after the next election).

Nervous Tory backbenchers, already wary of local elections in May and European elections in 2014, are already starting to sound the alarms of a leadership challenge against Cameron, though it’s nothing (yet) like the kind of constant embattlement that plagued former Labour prime minister Gordon Brown.

Former Conservative prime minister Margaret Thatcher faced an even more dire midterm slump in the early 1980s and still managed to win the 1983 general election handily, but if the current Labour lead settles or even widens, political gravity could well paralyze the government in 2013 and 2014 in the same way as Brown’s last years in government or former Tory prime minister John Major’s.

It’s worth pausing to note what the Cameron-led coalition government has and has not done.
