Why the US needs to start thinking about a Scottish policy

I write in The National Interest on Tuesday that as the pro-independence ‘Yes’ campaign narrows the gap with unionists in advance of the September 19 referendum, and it becomes more feasible that Scotland could become an independent, sovereign country, the United States needs to start thinking about a cohesive foreign policy regarding Scotland.scotlandUSflag

First minister Alex Salmond (pictured above in New York earlier this month) is leading the ‘Yes’ campaign, and he’s been a thorn in US-British relations for quite some time — both to US president George W. Bush (Salmond vehemently opposed the US invasion of Iraq) and to Barack Obama (Salmond’s government in 2009 released Abdelbaset al-Megrahi, convicted for his role in the 1988 bombing of Pan Am Flight 103 over Lockerbie, on health grounds).

But if Scotland becomes an independent country, it will require a huge rethink for the ‘special relationship’ between the United States and the United Kingdom, and the economic, diplomatic and security  consequences of what would presumably be a ‘special’ tripartite relationship among the United States, Scotland and the United Kingdom of England, Wales and Northern Ireland:

Though polls still show that the ‘No’ camp is leading, U.S. policymakers should be taking the possibility of an independent Scotland more seriously and, accordingly, preparing for the possible repercussions of a successful ‘Yes’ vote for U.S.-Scottish relations.

No third country has a greater stake in the outcome of the Scottish vote than the United States, which would have to reconfigure its ‘special relationship’ with what presumably would be the ‘United Kingdom of England, Wales and Northern Ireland,’ while formulating a wholly new relationship with an independent Scotland. It’s a relationship that the United States has never had to consider seriously, given that when Scotland and England merged with the Act of Union in 17o7, the original American colonies were still sixty-nine years away from declaring independence.

Momentum shifts in favor of Scottish independence

Tavish Scott, the Lib Dem member of the Scottish parliament (MSP) for Shetland, says Mr Darling and Better Together have done well at providing an intellectual case for remaining in the UK, but have failed to connect with crucial sections of the electorate such as traditional Labour voters. Mr Scott wants major Labour figures in Scotland such as former prime minister Gordon Brown and former UK minister John Reid to take a greater role in shoring up “soft Labour” support for the union.

What’s clear is that the ‘Yes, Scotland’ campaign in favor of independence is gaining momentum, while the ‘Better Together’ campaign is losing steam.

Panelbase poll conducted between April 27 and May 4 shows that the ‘No’ side would win 46% of the vote and the ‘Yes’ side would win 41% of the vote, with 14% undecided. Though Panelbase has typically shown a stronger ‘Yes’ vote than other polls, its findings are consistent with other surveys over the past month. While ‘No’ continues to lead ‘Yes,’ sometimes by double-digit margins, there’s no escaping that the polls are tightening.

That’s causing some alarm within both government and opposition circles. Though British prime minister David Cameron almost certainly believed that most Scottish voters wouldn’t support independence when he agreed to the terms of the referendum with Scottish first minister Alex Salmond last May, his governing Conservative Party must now face the prospect of a too-close-to-call referendum in Scotland just eight months before the wider UK general election in May 2015.

If Scotland votes ‘yes,’ or even comes close to endorsing independence, some senior Tories are already wondering if Cameron will have to resign — after 307 years of union with  England, he’ll be the prime minister who ‘lost’ Scotland.

With the Scottish Labour Party largely leading the charge against independence, what will it say about the generation of national Labour leadership, including includes Scottish-born prime minister Tony Blair, that delivered devolution  Scotland in 1997?

Miliband’s EU hedge makes a disastrous referendum more likely

edmiliLabour leader Ed Miliband announced yesterday that, if elected prime minister after next year’s general election, he would not hold a referendum on the United Kingdom’s continued (now 41-year) membership on the European Union.United Kingdom Flag Icon

At first glance, it sounds like exactly the type of pledge that plenty of pro-European British constituencies, including much of the business community, would applaud — eliminating the uncertainty of the United Kingdom’s future within the European Union that features prominently in the current government’s referendum promise.

It’s hard to see what Miliband has to gain politically or strategically with his new pronouncement on a future EU referendum, a essentially in reaction to Cameron’s position from last year.  It will satisfy neither pro-European nor anti-European voices, allows Cameron to bill himself as a champion of democratic choice, adds additional uncertainty (especially with the likelihood of a new Berlin-led EU treaty effort in the years ahead), and locks Miliband into what could be incredibly short-sighted  policy.

When I first saw it, I thought it was a joke — surely this was Galifianakis somehow video-shopping the president of the United States into a forum that’s otherwise reserved for the likes of spanking Justin Bieber.

Swiss immigration vote threatens access to EU single market

2007SVPAn infamous campaign poster from the 2007 Swiss election that depicts a flock of white sheep inside Switzerland, with one kicking a black sheep outside — the implication being that the right-wing Swiss People’s Party (SVP, Schweizerische Volkspartei in German; UDC, Union démocratique du centre in French) would tighten immigration policies to keep out migrants and perhaps reverse the trend of greater immigration to Switzerland in recent years.  Critics pointed out the nastier racist undertones of the poster.swiss

It’s that advertisement that I had in mind today as Swiss voters elected by a narrow 50.3%-to-49.7% margin to adopt an initiative ‘against mass immigration’ that would introduce quotas to Swiss immigration, despite the wishes of the Swiss government and Swiss business interests and the warnings of top EU officials.  The result threatens the existing treaties between Switzerland and the European Union that guarantee the free movement of persons, one of the four ‘core’ EU freedoms.

It’s a significant victory for the SVP, which has emerged as a major force in Swiss politics through its forceful advocacy of a nationalist, conservative agenda to restrict immigration and oppose greater EU integration.

The result means that the Swiss government now has three years either to renegotiate or revoke the bilateral agreement finalized in 2002 with the European Union over free movement of persons.  That treaty is part of a larger package that provided Switzerland access to the EU single market in exchange for enacting certain aspects of EU policy, and it’s part of a wider process that has more closely integrated Switzerland with the European Union over the past decade.  The country’s historic independence means that it’s never seriously pursued EU membership — Switzerland joined the United Nations only in 2002, after all.   Continue reading Swiss immigration vote threatens access to EU single market

Scotland passes same-sex marriage, joining England and Wales

Though the UK parliament in Westminster enacted same-sex marriage in July 2013 to great fanfare, the nature of devolution in the United Kingdom meant that Scotland’s parliament in Holyrood would have to pass its own version.United Kingdom Flag Iconscotland

The devolution process that began in 1997 under Labour prime minister Tony Blair created parliaments for Wales, Scotland and Northern Ireland.  But regional devolution ran deepest in Scotland — Wales opted for fewer regional powers than Scotland, and Northern Ireland’s parliament, created as part of the 1998 Good Friday Agreement, spent much of the 2000s suspended.  Ironically, that meant that for a brief period, same-sex marriage would be the law of the land in England in Wales, but not in the more socially liberal Scotland.

That changed today, when the Scottish parliament voted 105 to 18 in favor of enacting same-sex marriage.  First minister Alex Salmond, who leads a pro-independence government of the Scottish National Party (SNP) fast-tracked the bill to keep pace with Westminster.  Though the bill wasn’t without controversy, especially from within the Church of Scotland and other religious groups, support within the Scottish Labour Party and the Scottish Liberal Democrats meant that the bill was always likely to sail through Holyrood.

Though the major opposition to same-sex marriage in England and Wales came from within the Conservative Party of prime minister David Cameron (who himself supported marriage equality), the leader of the Scottish Conservative and Unionist Party, Ruth Davidson (pictured above), is herself gay and strongly supported the marriage equality effort in Scotland. Though the Tories hold just 15 seats in the 129-member Scottish parliament (compared to 65 seats for the SNP and 37 for Labour), Davidson and Cameron have shown that conservatism and marriage equality aren’t necessarily incompatible.

The lengthier Scottish consultation process on the same-sex marriage bill included outreach to hear the views of religious groups, and churches will have the right (though not the obligation) to ‘opt in’ to same-sex marriage in Scotland when the law takes effect later this year.  That makes the Scottish same-sex marriage act somewhat stronger than the English version, which provides a blanket ban on same-sex ceremonies within the Church of England.

The first same-sex marriages in England and Wales will take place in March, and the first marriages in Scotland will take place later in autumn 2014.

It also leaves Northern Ireland as the only part of the United Kingdom without same-sex marriage — and as I wrote last summer, don’t expect the Northern Irish assembly at Stormont to take up the cause of LGBT equality anytime soon:  Continue reading Scotland passes same-sex marriage, joining England and Wales

Separatists from Québec to Barcelona will be watching Scotland’s historic vote on independence in the autumn, which could end over three centuries of union between Scotland and England, bringing the United Kingdom as we know it to an end.

Scottish nationalists, buoyed by the economic hopes of North Sea oil, have increasingly floated the idea of independence since the 1970s.  Scotland’s rift with Tory prime minister Margaret Thatcher in the 1980s only alienated the country further from Westminster, and the election of Labour prime minister Tony Blair in 1997 led to the devolution of many Scottish domestic matters to a new regional parliament at Holyrood.  Since 2007, the Scottish government has been led by the Scottish National Party (SNP) and first minister Alex Salmond.  In the most recent May 2011 Scottish elections, the SNP was so popular that it won a majority government — a feat that the Scottish electoral system was specifically designed to avoid.

Salmond and his popular deputy first minister Nicola Sturgeon will lead the ‘Yes’ campaign for Scottish independence following the agreement that Salmond and British prime minister David Cameron struck in March 2013 on the referendum’s date and its terms.  Proponents are likely to paint a vision of Scotland as an independent nation that has more in common with the Nordic welfare states than with Anglo-American capitalism.  Though Scotland’s 5.3 million residents comprise just around 8.4% of the total UK population, Scotland has retained a proud and distinct culture and a discrete linguistic and intellectual tradition, and it veers politically to the left of England.

Cameron, the leader of the center-right Conservative Party, will help lead the ‘No’ campaign, which has already been christened the ‘Better Together’ campaign.  But the relative unpopularity of Cameron and the Tories in Scotland means that he’ll need help from the centrist Liberal Democratic Party and the center-left Labour Party.  In particular, Alistair Darling, the former Labour chancellor of the exchequer under prime minister Gordon Brown (both of whom are Scottish) is chairing the ‘Better Together’ effort.  Although the ‘No’ campaign will try to convince Scots that they are, in fact, better off staying in the United Kingdom, it will also point to obstacles that an independent Scotland could face.  Chief among those obstacles might be Scotland’s position in the European Union — although Scots are generally more pro-EU than their English counterparts, it’s not clear whether an independent Scotland would automatically join the European Union or would be forced to apply for readmission.  Scotland would also face protracted negotiations with England (or perhaps the ‘United Kingdom of England, Wales and Northern Ireland’) over splitting the current UK debt burden, as well as defense, currency, immigration, citizenship and other myriad arrangements.

Polls show that Scottish voters today oppose independence — around 40% to 55% of voters would vote ‘No,’ and just around 25% to 35% would vote ‘Yes.’  But the campaigns won’t hit top speed until later in 2014 after the UK vote to elect members to the European Parliament.

Aftermath: Veteran’s Day/Remembrance Day on the eve of the 100th anniversary of WWI

It’s Veteran’s Day here in the United States, it’s Remembrance Day in the United Kingdom, and accordingly, that means it’s also Armistice Day marking the end of hostilities between Germany and the Allied forces during World War I — it’s a day for remembering the sacrifices of soldiers in eras past as well as the ugly sacrifices that all war necessarily entails.poppyUK

Carl von Clausewitz wrote in his classic tract On War that politics is war by other means, and one of the motivating elements of Suffragio comes from understanding how different countries use politics (in both democratic and non-democratic states) to solve policy problems and how a country’s unique culture, economics, language and history all play a role in understanding how countries solve problems.  What’s remarkable about the world today isn’t that so many of its countries are still engaged in bloody wars, but that so many regions and countries now use politics, and not war, to solve their differences.

Next July marks the 100th anniversary of the assassination of Austro-Hungarian archduke Franz Ferdinand, the singular event that set into motion a series of domino effects that launched Europe, and then much of the rest of the world, into the ‘war to end all wars.’  Siegfried Sassoon (pictured above), a British soldier who served on the Western Front in World War I and survived the slaughter to live to age 81, became the most well-known of several WWI-era poets who came to profound disillusion over the war.

As such, I can’t think of a more appropriate way to mark the day than with his poem, ‘Aftermath.’

Don’t blame the constitution for the shutdown — blame single-member plurality districts!

Dylan Matthews at The Washington Post wrote impressively yesterday about the perils of presidentialism and blames the current federal government shutdown not on the individual actors in the US Congress, but on the US constitution itself.  Citing the late Juan Linz, who died Tuesday (coincidentally), Matthews points to a body of comparative politics research that shows presidential systems are more likely to fall into dictatorship and chaos than parliamentary systems:USflag

But it’s not just that [James] Madison’s system is unnecessary. It’s potentially dangerous. Scholars of comparative politics have shown that presidential systems with a separation of executive and legislative functions, like America’s, are considerably more likely to collapse into dictatorship than are parliamentary systems where the executive and legislative branches are merged. That’s because there are competing branches of government able to claim democratic legitimacy and steer the ship of state at the same time — and when they disagree profoundly, there’s no real mechanism for resolving the dispute.

But parliamentary systems come with their own challenges.  Italian prime minister Enrico Letta, who won a no-confidence vote yesterday after a four-day political crisis spurred by the whimsy of a single, highly volatile opposition leader, may disagree that parliamentary systems are necessarily more stable.

Matthews is right to poke holes in the sanctity with which the US political system holds 18th century governance documents, including the US constitution and the writings of Madison and others (after all, it’s important to remember that the original constitution plunged the United States into civil war — it’s the post-1865 version that includes the 13th, 14th and 15th Amendments that we use today).

We live in a 21st century world that doesn’t always fall into sync with 18th century political economy.  The US constitution, whether Americans like it or not, is no longer state-of-the-art technology for constitutions and hasn’t been for decades, and the US presidential system isn’t one that many countries choose to follow these days.  When the United States helped craft new political systems in Germany and Japan after World War II, they built parliamentary governments with mechanisms alien to the American system.

But in a world where a minority of one house of the legislative branch of government can shut down the US government, it’s a tall order to ask that American political elites contemplate a major constitutional adjustment — a constitutional amendment to transform the United States into a parliamentary system would require the support of two-thirds of the US House of Representatives and the US Senate and the support of three-fourths of the 50 US states.

While we’re working through thought experiments, can we can lay some of the blame on the nature of the American electoral system?  Maybe the United States should elect members of Congress through some form of proportional representation (or ‘PR’) instead of a ‘first-past-the-post’ system — more technically, single-member district plurality.

Although it’s typical to think about PR as a voting system used more often in parliamentary systems, both Canada and the United Kingdom (which have parliamentary systems) use a pure ‘first-past-the-post’ system to elect members to each of their respective House of Commons, while México (which has a presidential system) uses a mixed system that relies heavily on PR to determine members of both houses of its Congress.

How first-past-the-post skews US congressional elections: the 2012 conundrum

In the United States, House members are elected in single-member districts on the basis of ‘first-past-the-post’ voting.  That means that the candidate who wins the most votes in the district wins the House seat.  Typically in the United States, at least, that means the winning candidate will win over 50% of the vote (or close to it) because of the cultural dominance of the two-party system.  That kind of two-party dominance, by the way, is much more likely to develop under the American electoral system (first-past-the-post in single-member districts) than under PR systems.  That phenomenon even has a name — Duverger’s Law — and we could spend a whole post pondering the mechanisms and effects of it.

So in the most recent November 2012 US congressional election, Democrats won 48.3% of the national vote and Republicans won 46.9% for the national vote.  But Democrats won just 201 seats to 234 for Republicans — the party that won 1.7 million fewer votes nonetheless holds a fairly strong majority of seats in the House (by historical standards).

The skew is even more intense on a state-by-state basis.  Here’s a chart that shows five swing states that US president Barack Obama won in his November 2012 reelection bid where Republicans simultaneously won a majority of the state’s congressional delegation — the first column is Obama’s reelection percentage and the second column is the percentage of that state’s House seats held by Republicans:

It works both ways — here’s another chart that shows five solidly Democratic states where Democrats hold an outsized advantage in the House.  Again, the first column is Obama’s reelection percentage and the second column in the percentage of House seats held by Democrats:

What would proportional representation mean for the US House? 

Contrast this to a PR system where seats are awarded on the basis of the party’s overall level of support.  There are nearly as many varieties of PR electoral systems as there are countries on the map, but the general idea is that if a party wins 25% of the vote, it should hold 25% of the seats in the legislative body.  Often, there’s an electoral hurdle — so a party would have to win 4% of the total vote in order to win any seats in the legislative body. Despite the success of pro-EU parties in Norway, don’t expect EU membership anytime soon

One of the odder results of this week’s Norwegian election is that while it boosted the numbers of seats for the two parties that are most in favor of membership in the European Union, Norway is today less likely than ever to seek EU membership.European_Unionnorway

Together, the center-left Arbeiderpartiet (Labour Party) and the center-right Høyre (the Conservative Party) will hold 103 seats as the largest and second-largest parties, respectively, in the Storting, Norway’s 169-member parliament — that’s a larger number of cumulative seats than the two pro-European parties have won since the 1985 election.

But EU membership is firmly not on the agenda of Norway’s likely new prime minister, Erna Solberg, just like it wasn’t on the agenda of outgoing  prime minister Jens Stoltenberg during his eight years in government.

One of the obvious reasons is that EU membership is massively unpopular among Norwegians — an August poll found that 70% oppose membership to just 19% who support it.

Proponents of EU membership argue that because Norway is part of Europe’s internal market, it is already subject to many of the European Union’s rules. (Norway is also a member of the Schengen free-travel zone that has largely eliminated national border controls within Europe)  But until Norway is a member of the European Union, it has absolutely no input on the content of those rules.  Stoltenberg (pictured above left with European Council president Herman Van Rompuy) has called the result ‘fax diplomacy,’ with Norwegian legislators forced to wait for instructions from Brussels in the form of the latest directive.

Since 1994, when Norwegians narrowly rejected EU membership in a referendum, Norway has been a member of the European Economic Area (EEA), an agreement among the EU countries, Norway, Iceland and Liechtenstein that allows Norway and the other non-EU countries access to the European single market.

Opponents argue that Norway, with just 5 million people, would have a negligible input in a union that now encompasses 28 countries and nearly 508 million people.  They also argue that with one of Europe’s wealthiest economies, Norway would be forced to contribute part of its oil largesse to shore up the shakier economies of southern and eastern Europe.  There are also sovereignty considerations for a country that didn’t win its independence from Sweden until 1905 — and then suffered German occupation from 1940 to 1945.  Though Norwegians also often cite the desire to keep their rich north Atlantic fisheries free of EU competition, Norway already has a special arrangement with the European Union on fisheries and agriculture, and it’s likely that it would continue to have a special arrangement as an EU member, in the same way that the United Kingdom has opted out of both the eurozone and the Schengen area and has negotiated its own EU budget rebate.

Though Solberg herself is from Norway’s western coast, her party’s base is comprised largely of business-friendly elites in Oslo and Norway’s other urban centers, where support for EU membership runs highest.  But that enthusiasm doesn’t always flow down to voters who support Solberg, and it certainly doesn’t extend to Norway’s other right-wing parties.  Continue reading Despite the success of pro-EU parties in Norway, don’t expect EU membership anytime soon

On Europe, the real question for the UK is whether it wants separation or divorce

Amid all of the discussion of British prime minister David Cameron’s plan to renegotiate certain opt-outs (on immigration or justice, perhaps) from the rest of the European Union and to hold an ‘in-or-out’ referendum if he wins reelection in May 2015, the question is typically framed as ‘should Britain stay in the European Union?’

But on the basis of 40 years of British membership in the European Union, it seems clearer that the United Kingdom has already left the European Union in a meaningful sense, and even when it entered what was then the European Economic Community, it was never incredibly keen with the concept of ever closer union.

Alternatively, policymakers should concede the reality of British reluctance for more cooperation and frame the question in terms of whether the British should seek an informal separation or a formal divorce:

But as European citizens ponder the consequences of whether the British people will vote to end what’s been a dysfunctional four-decade relationship with the European Union, the question of whether Britain is going to leave the EU has become redundant — Britain, in many ways, has been leaving the Union since virtually the day it became a member.  Accordingly, the real question for British and Europe is whether the British will opt for a separation or for a divorce. We argue that separation, a detailed membership renegotiation, is the better option for both sides rather than a complete exit….

[With] British public opinion increasingly inclined to leave the European Union, it is even more important to frame the question of Britain’s relationship with Europe in realistic terms, however difficult that may be to accept.  While the terms of separation of British association with many core aspects of the European Union may be difficult for European leaders to stomach, it may be the best alternative to a more formal divorce that seems likely to happen if policymakers in London, Brussels and Berlin continue to deny the reality that British-EU relations will never be — and never have been — amorous.

 

 

How to distinguish Obama’s congressional vote on Syria from Libya example

With a surprise twist on a holiday weekend in the United States, president Barack Obama announced that he would seek a vote in the U.S. Congress prior to launching a missile strike on Syria in retribution for last Wednesday’s chemical attack on the outskirts of Damascus.USflagSyria Flag Icon freesyriaLibya_Flag_Icon

Coming in the wake British prime minister David Cameron’s humiliating defeat over a resolution in the House of Commons authorizing the possibility of British force late last week, Obama argued that, while he has already made a decision to punish Syrian president Bashar al-Assad for the chemical attacks in his capacity as commander-in-chief of the U.S. armed forces, he has also decided to seek authorization for use of force from Congress:

Having made my decision as Commander-in-Chief based on what I am convinced is our national security interests, I’m also mindful that I’m the President of the world’s oldest constitutional democracy.  I’ve long believed that our power is rooted not just in our military might, but in our example as a government of the people, by the people, and for the people.

Obama’s surprise announcement postpones any US action until at least the week of September 9 — well after chemical weapons inspectors from the United Nations will report back next week about the nature of the attack and well after next week’s G20 meeting in St. Petersburg, Russia, where president Vladimir Putin, an Assad ally, has repeatedly blocked action against Assad (a Russian ally) by the UN Security Council and earlier today, called the possibility of US and Western punitive strikes ‘utter nonsense.’

While Obama’s decision will hearten critics on both the American left and right who have called for a greater legislative role on the Syria question, it’s unlikely to satisfy hawkish critics like U.S. senator John McCain of Arizona who has pushed Obama toward supporting regime change in Syria, and it’s also unlikely to satisfy dovish critics who believe there’s no U.S. national interest in launching military strikes on the Assad regime.  It will also leave multilateralist critics dissatisfied, given that Obama stated clearly that he was willing to act without the backing of what he called a ‘paralyzed’ Security Council.

But it’s also an unexpected position for an administration that pushed the boundaries of the 1973 War Powers Resolution just two years ago when it ordered military action in Libya.  At first glance, Obama’s 2011 decision to support the UN-authorized, NATO-enforced effort to establish a no-fly zone and to arm rebels fighting against Libya’s late strongman Muammar Gaddafi without congressional authorization arguably violated his constitutional obligation to Congress, while a limited military strike on Syria lasting just a few days to a few weeks would not require congressional approval under any view of the War Powers Resolution.

So what gives?  How can the Obama administration reconcile its position on Libya with its newfound enthusiasm for Congress on the Syrian question?  The answer could transform the nature of U.S. foreign policy and the ability of the U.S. president to act decisively in the future. Would a Miliband-led Labour government be an improvement on British civil liberties?

The troubling case of David Miranda, the partner of Guardian reporter Glenn Greenwald, who was detained by British police at Heathrow yesterday for nine hours under schedule 7 of the U.K. Terrorism Act, is now a full-blown fully international incident. United Kingdom Flag Icon

The case has implications not only for U.S. politics (Greenwald has been the chief source for the leaks about the U.S. National Security Agency’s Internet intelligence-gathering programs) and even Brazilian politics (Greenwald lives in Brazil with Miranda, a Brazilian native), but for British politics as well, where the issue of civil liberties has been contentious for the past decade and a half under both the Labour governments of Tony Blair and Gordon Brown and the Conservative-led government of current prime minister David Cameron.

Political strategist Ian Bremmer is already suggesting that the United States and/or the United Kingdom may be preparing an indictment against Greenwald (presumably under the U.S. Espionage Act), which would explain why Miranda’s laptop computer and other personal effects were confiscated in London.  We already know that the United States, by the admission of White House deputy press secretary Josh Earnest was given a heads-up by London prior to Miranda’s detention, though Earnest has denied that the United States requested or collaborated with the detention.  It’s equally plausible that overeager police officials in London jumped at an opportunity to gather information they thought top U.S. and U.K. officials would appreciate — if the United States and the United Kingdom really are pursuing an international case against Greenwald, you’d think they would be careful not to commit what seems like a prima facie violation of the U.K. Terrorism Act.

With both Scotland Yard and Cameron saying little about the incident, and with U.S. officials remaining relatively mum, most of today’s discussion has been dominated by vehement critics of the detention on both sides of the Atlantic.

One of the most striking has come from Labour Party’s shadow home secretary, Yvette Cooper, a rising Labour star who may herself one day lead the party, who has called for an investigation into whether the detention was appropriate under the Terrorism Act:

Schedule 7, which applies only at airports, ports and border areas, controversially allows officers to stop, search, question and detain individuals. Miranda was held for nine hours, the maximum the law allows before officers must release or formally arrest the individual.

According to official figures, most examinations under schedule 7 – over 97% – last less than an hour, and only one in 2,000 people detained are kept for more than six hours. It has been widely criticised for giving police broad powers under the guise of anti-terror legislation to stop and search individuals without prior authorisation or reasonable suspicion – setting it apart from other police powers.

As we approach the annual convention period in British politics, pressure on Labour leader Ed Miliband is growing to draw a deeper contrast with the current coalition government on many issues, including civil liberties.  Soon after his election as Labour leader in September 2010, Miliband criticized his party’s overreach on civil liberties, identifying in particular the Blair government’s plan to hold suspects for 90 days without trial and the broad use of anti-terrorism laws.  At the time, Miliband argued that he wanted to lead Labour to reclaim the British tradition of liberty, though Miliband also indicated at the time he supported Blair’s widespread introduction of what are now over 4 million closed-circuit television surveillance cameras throughout the country.

As the parties begin to jostle for position for an election that’s now just 21 months away, Cameron certainly won’t be able to run for reelection on as vigorous a pro-liberty position as he did in 2010, though his junior coalition partners, the Liberal Democrats, can point to their success in repealing Labour’s plan to introduce national ID cards and scrapping the Tories’ proposed communications data bill this year.

That leaves a key opening for Miliband to champion civil liberties, but given the durability of the British surveillance state and Labour’s role in creating the legal framework last decade for the British surveillance state, it is unclear whether Miliband will do so, though Cooper delivered a high-profile speech in July arguing for more oversight and protections in relation to the U.K. intelligence and security services.  It’s likelier, however, that a future Labour government will pursue many of the same pro-security policies that each of the Blair, Brown and Cameron governments have pursued.

Hey! What about gay marriage in Scotland and Northern Ireland?

Amid the fanfare that much of the United Kingdom would now enjoy full same-sex marriage rights following the success of Conservative UK prime minister David Cameron in enacting a successful vote earlier this week in Parliament, some LGBT activists are still waiting at the altar of public policy for their respective day of celebration.United Kingdom Flag Iconscotlandnorthernireland

Under the odd devolved system within the United Kingdom of Northern Ireland and Great Britain, it’s up to the separate Northern Ireland Assembly to effect its own laws on marriage.  Even within Great Britain, the Scottish parliament, likewise, has the sole power to enact legislation related to marriage rights.

So while nearly 90% of the residents of the country will now be able to enter into same-sex marriages, Scottish and the Northern Irish will have to wait a little longer — and in the case of Northern Ireland, it seems like the wait will be lengthy. Scotland, with 5.3 million people (8.4% of the total UK population), and which will vote on independence in a referendum in September 2014, is already taking steps toward passing legislation, though Northern Ireland, with 1.8 million people (2.9% of the UK population), has already considered and rejected same-sex marriage.

The reason for the disparity within the United Kingdom goes back to former Labour prime minister Tony Blair.

Under the broad devolution process that his ‘New Labour’ government initiated upon taking power in 1997, much of the power to regulate life in Scotland was devolved from Westminster to the new parliament that met for the first time in 1999 at Holyrood.  Although a parallel Welsh Assembly exists in Cardiff for Welsh affairs, the Welsh parliament lacks the same breadth of powers that the Scottish parliament enjoys, which is why the Welsh now have same-sex marriage rights. (Take heart, Daffyd!)

Northern Ireland has a similar arrangement, with its own devolved Northern Ireland Assembly at Stormont, though its powers were suspended from 2002 to 2007 when the Northern Ireland peace process fell apart, however briefly.

The disparate courses of English, Scottish and Northern Irish marriage rights are a case study in how devolution works in the United Kingdom today.

Scotland: Holyrood poised to pass an even stronger marriage equality bill in 2014

Scotland’s local government, led by Alex Salmond and the Scottish National Party, introduced a same-sex marriage bill late in June that is set to provide an even more liberal regime of marriage rights.  While the marriage bill passed earlier this week in London actually bans the Anglican Church of England from offering same-sex marriage ceremonies, the Scottish bill won’t have the same prohibitions on the Presbyterian Church of Scotland, which is seen as somewhat more relaxed about gay marriage.  Like the English legislation, however, the Scottish bill offer protections to ministers on religious grounds who do not choose to officiate same-sex marriages.

Although there’s opposition to the bill within the governing SNP as well as the Scottish Labour Party and the Scottish Liberal Democratic Party, the Conservative Party has very little influence outside England and Scotland, generally speaking, is even more socially progressive than England, which means that the legislation is widely expect to pass in the Scottish Parliament early next year, with the first same-sex marriages in Scotland to take place in 2015.

Northern Ireland: gay marriage as a football between Protestant and Catholic communities

Earlier this year, the Northern Ireland Assembly considered a same-sex marriage bill, but it was defeated in April by a vote of 53 to 42 — a similar motion was defeated in October 2012 by a similar margin. Since 2005, LGBT individuals have been able to enter into civil partnerships (with most, though not all, of the rights of marriage enjoyed by opposite-sex partners) throughout the entire United Kingdom, including Northern Ireland.

When Scotland passes its gay marriage bill next year, however, it will leave Northern Ireland as the only part of the United Kingdom without marriage equality.

Not surprisingly, given that Northern Ireland was partitioned out of the Republic of Ireland in 1921 largely on religious lines, and Protestant-Catholic violence has plagued Northern Ireland for much of the decades since, Northern Ireland is the most religious part of the United Kingdom.  A 2007 poll showed that while only 14% of the English and 18% of Scots were weekly churchgoers, fully 45% of the Northern Irish attended church weekly.

Unlike Scotland, where the mainstream UK political parties, such as the Tories, Labour and Liberal Democrats, aim to compete with the Scottish Nationalists (with varying degrees of success), Northern Irish politics are entirely different, based instead on the largely Protestant ‘unionist’ community and the largely Catholic ‘nationalist’ community.  Around 41% of Northern Ireland is Roman Catholic, while around 41.5% of Northern Ireland is Protestant (mostly the Presbyterian Church and the Anglican Church of Ireland).

That helps explain why the opposition to gay marriage in Northern Ireland remains so strong, and it doesn’t help that the issue falls along the same lines as the entrenched unionist and nationalist divisions.  Given that it’s unlikely either community will come to dominate Northern Irish politics and the Assembly anytime soon, it means that proponents of same-sex marriage will have to convince at least some unionists to join forces with largely supportive nationalist parties to pass a marriage bill — and that may prove a difficult task for a five-way power-sharing government in Belfast that has enough difficulties even without gay marriage.  Continue reading Hey! After Britain and France, will Vietnam be the next country to enact same-sex marriage?

Now that the House of Lords has approved changes to the same-sex bill in Parliament in the United Kingdom, same-sex marriage is set to become a reality in England and Wales (a separate Scottish bill is set to follow) under Conservative prime minister David Cameron.vietnam

That follows the final enactment of same-sex marriage in France earlier this summer — though the center-right and far right have vocally opposed it, the Assemblée nationale passed the measure with ease in June, fulfilling one of president François Hollande’s key campaign promises.

Great Britain (once Scotland joins) will become the 14th nation-state to have enacted legal same-sex marriage, joining France and eight other European countries,* as well as Argentina, Brazil, Canada and South Africa.  That doesn’t include México City or the 13 states (and the District of Columbia)** in the United States that have enacted marriage equality, which comes with the full set of rights and privileges of federal law following the recent U.S. Supreme Court ruling in United States v. Windsor that rules the 1996 Defense of Marriage Act unconstitutional.  Last month, Germany’s constitutional court delivered same-sex partnerships a key victory by ruling that they are entitled to the same tax rights as other married couples.

So what’s the next horizon in what’s become a global fight for LGBT rights and marriage equality?

Vietnam.

Probably not what you were thinking, right?  After all, Asia has not typically been the most hospitable battleground for LGBT rights.

Moreover, Vietnam is a socialist republic and a one-party state ruled by a party, the Đảng Cộng sản Việt Nam (Vietnamese Communist Party), that’s been enshrined through Vietnam’s constitution as the sole organ of political affairs since 1975, when North Vietnam formally overran South Vietnam, thereby uniting the entire country under communist rule.  The Vietnamese government is repressive on just about every other vector — press freedom, internet freedom, and of course, the kind of political freedom that would allow a challenge to the governing elite.  Though the country has been transformed economically as its one-time Marxist roots have been eroded into a more state capitalist approach, and its top destination for exports is now the United States (relations between the two countries have now been normalized for nearly two decades), the zeal for liberalization hasn’t met with the same enthusiasm in other quarters.

Vietnam is most well-known internationally for its economic growth — it’s a ‘Next Eleven‘ country and, while its GDP growth has slowed in recent years, it’s still poised to become a breakout economic power in southeast Asia.  It’s also a party to the ambitious Trans-Pacific Partnership negotiations that could ultimately establish a free-trade zone among the United States and other South American and Asian countries.

It’s less well-known for its positions on social justice, but it would be a huge coup for the global marriage equality movement — with over 90 million people, it’s the 13th most populous country in the world, and it would be the first Asian jurisdiction to recognize same-sex marriage.  Continue reading After Britain and France, will Vietnam be the next country to enact same-sex marriage?
