What a DUP-dependent government means for the UK

What seemed like a certainty in the wee hours of the morning on Friday, June 9, now seems far more treacherous nearly a week later.

British prime minister Theresa May may have assured nervous Conservative MPs Monday that she can steady a minority government. With contrition for her campaign missteps and the loss of 13 seats (and the Tory majority that David Cameron won just two years ago) and claiming, ‘I got us into this mess, and I will get us out,’ May seems to have united her parliamentary caucus, at least temporarily, behind her leadership.

But it may be even more difficult than May might have realized to secure and maintain a ‘confidence and supply’ arrangement with Northern Ireland’s socially conservative Democratic Unionist Party (DUP). Though a formal coalition was always unlikely, May will need the DUP’s 10 MPs to have any hope of a reliable majority in the House of Commons.

The deeply evangelical DUP’s hard-line stand on abortion, women’s rights and LGBT rights (its founder, Ian Paisley, once led a famous ‘Save Ulster from Sodomy’ campaign) have alarmed many, including some leading Tories, such as the Scottish Conservative Party’s openly gay leader Ruth Davidson, whose newly elected bloc of 13 MPs may function as a liberal (and relatively pro-European) Tory bulwark in the new parliament.

Notably, in Northern Ireland, reflecting trends that began in the early 2000s and have only accelerated since, the DUP and the republican Sinn Féin each won record numbers of seats. Ironically, that benefits May in two ways. First, it gives her more DUP MPs to shore up a Tory-led majority; second, it means a smaller number to reach an absolute majority in the House of Commons. That’s because Sinn Féin, which advocates Northern Ireland’s ultimate unification with the rest of Ireland, refuses to swear an oath to a British monarch and, correspondingly, refuses to take its seats at Westminster. With those seven Sinn Féin MPs abstaining, it means May needs three less MPs in total for a majority.
Forebodingly, former prime minister John Major on Tuesday warned May against working with the DUP, even as May was engaged in negotiations the same day with DUP leader Arlene Foster and deputy DUP leader Nigel Dodds to foster an agreement. (The pending Tory-DUP deal was, according to reports, set to go ahead on Wednesday, but has been postponed until next week in light of the deadly blaze at Grenfell Towers). Major joins a growing chorus of leading figures urging caution, including Jonathan Powell, the Labour chief of staff who helped negotiate with Northern Ireland between 1997 and 2007, and Leo Varadkar, the newly elected Fine Gael leader who became Ireland’s taoiseach on Wednesday.

Why everyone from Major to Labour is so wary of the DUP

Major’s wariness comes, in part, from his own history.

After Major won an unexpected victory in the 1992 general election against Neil Kinnock’s Labour, the Conservatives lost their majority in December 1996 due to by-election losses and attrition, and Major turned to the then-dominant force in Northern Ireland’s unionist and Protestant politics, the Ulster Unionist Party (UUP). That arrangement lasted barely six months, coming right before the ‘New Labour’ landslide that swept Tony Blair into power in May 2017.

The UUP was, at the time, engaged in the negotiations that would two years later blossom into the ‘Good Friday’ Agreement. The UUP leader, David Trimble, shared the 1998 Nobel Peace Prize with his counterpart John Hume, the leader of the republican (and largely Catholic) Social Democratic and Labour Party (SDLP).

While Major’s government leaned on the Ulster Unionists, the DUP in the 1990s was a far more right-wing and recalcitrant group. Indeed, the Tories have never formally turned to the DUP for support like May is now doing.

Founded in 1971 by Paisley, a Presbyterian fundamentalist preacher, the DUP bitterly opposed the Good Friday Agreement on the grounds that it allowed the republican Sinn Féin, a party with ties to the Irish Republican Army, to hold public office. By the early 2000s, moreover, the DUP had eclipsed the UUP as the leading unionist party in Northern Ireland, while Sinn Féin was itself eclipsing the SDLP as the leading party of the Catholic, republican left. Those tectonic changes in Northern Irish politics brought a halt, after just four years, to the widely hailed devolution in Northern Ireland, collapsing a power-sharing arrangement between the UUP and the SDLP.

Between 2002 and 2007, as internal unionist and republican politics were sorting in new directions, Northern Ireland reverted to a period of home rule through the Northern Ireland office. Eventually, the DUP and Sinn Féin agreed to a new power-sharing agreement of their own, a step that more firmly enshrined the Good Friday framework under Sinn Féin’s Martin McGuinness, on the one hand, and under the DUP, first under Paisley, then under his successor Peter Robinson and from January 2016 until January 2017, Foster.

McGuinness earlier this year bowed out of the power-sharing agreement over the botched Renewable Heat Initiative, a scheme hatched by Foster when she was Northern Irish minister for enterprise. The idea was to offer subsidies to businesses to use wood pellets and other renewable heat sources. But businesses instead abused those subsidies so corruptly that they ultimately received more subsidies than the total amount spent on wood pellets altogether, costing the Northern Irish government nearly £500 million.

A snap election in March did little to solve the impasse; Sinn Féin and the DUP essentially tied, and Sinn Féin came incredibly close to emerging as the leading party for the first time in Northern Irish history, as unionist parties lost their majority for the first time as well. McGuinness himself died days after the regional elections. When May called a snap election nationally, James Brokenshire, the secretary of state for Northern Ireland, prolonged the deadline to reach a deal until June 29, well after the general election result.

Under the Good Friday framework, the national government has an obligation of neutrality in helping various parties reach a power-sharing arrangement in the Stormont-based Northern Irish Assembly. Major and others worry that with the new Conservative government so dependent on DUP votes for its survival, that neutrality will be threatened. That’s doubly dangerous, first because it comes at a time when the power-sharing arrangement between the DUP and Sinn Féin is in danger of collapse after a decade and, secondly, because both unionists and republicans worry about the consequences of Brexit, with fears that the re-imposition of a genuine border could re-ignite tensions after EU guarantees and the Good Friday Agreement virtually erased it 20 years ago.

Moreover, a Tory-DUP deal might buy May just months, not years. In 2016, deaths, resignations and other matters resulted in seven by-elections for parliamentary seats. With the Tories now polling behind Labour in the wake of last week’s election, the DUP’s negotiating position would strengthen with every Conservative by-election loss, and a handful of by-election losses would render the Tory minority unsalvageable, even with DUP support.

So these are all legitimate concerns, of course, and it’s why May is wisely inviting leaders from all five major parties to discuss power-sharing in Northern Ireland, including Sinn Féin, on Thursday.

Reason to be optimistic about a Tory-DUP alliance?

While the stakes of a significant DUP role at Westminster are high, there’s nevertheless a strong chance that the DUP’s influence could ultimately benefit Northern Ireland and the United Kingdom more generally.

After all, if the late Martin McGuinness, a militant republican, could make a deal with the DUP, certainly Theresa May can too.

Deal or no deal, though, Sinn Féin seems unlikely to continue its power-sharing arrangement with the DUP so long as Brexit negotiations are ongoing, because signing off on a hard Brexit (or even a soft Brexit) would be so politically toxic for Sinn Féin. The DUP is the only party that supported Brexit last year, even though Northern Ireland backed ‘Remain’ by a margin of 56% to 44%. Sinn Féin’s voters overwhelmingly backed Remain, and they especially loathe the idea of re-introducing a border with the Republic of Ireland (which of course remains a full member of the European Union). Despite the incompetence of the ‘Cash for Ash’ scandal, it was always more a fig leaf for Sinn Féin than a genuine grievance.

Today, it feels like a near-certainly that home rule will become reality on June 29, and Brokenshire, the Conservative secretary of state for Northern Ireland, was always going to have greater unionist sympathies. That was true even when polls showed the Tories winning a 100-plus majority back in April.

Entering a period of home rule, Sinn Féin hopes (with some reason) to consolidate its growing position as the part of the Catholic republican left. Meanwhile, if it concludes a deal with May, the DUP likewise hopes to consolidate its own support by bringing more economic aid to  Northern Ireland as its price for floating May’s government. It’s a win-win situation for both parties, who see it as an opportunity for dual, perhaps fatal, blows to the UUP and the SDLP (and maybe the non-sectarian Alliance as well), all of which lost their remaining Westminster seats last Thursday.

It’s true that the DUP has an incredibly conservative position on social issues like gay rights, abortion and same-sex marriage. Northern Ireland is the only part of the United Kingdom where marriage equality isn’t the law of the land. But as even leading LGBT activists in Northern Ireland admit, the DUP’s stand today is far weaker than the Paisley view of the 1970s. Moreover, though it was Cameron who shepherded same-sex marriage though parliament in 2013, more Tories opposed it (134), including then-home secretary May, than supported it (126). So it’s not just the DUP that has had a tough time accepting LGBT rights and marriage equality.

Moreover, as the DUP and Sinn Féin have become the leading parties for their respective unionist and republican electorates, they’ve shed some of the harder edges of their pasts. The DUP is simply not the same today under Foster, who is Anglican (not Presbyterian) and who was originally elected as a member of the Northern Irish Assembly from the UUP before switching to the DUP in 2004, as it was under Paisley. Dodds, who has served as deputy leader since 2008, is a Cambridge-educated pragmatist and dealmaker.

The same is true for Sinn Féin, whose leader in Northern Ireland is Michelle O’Neill, a run-of-the-mill social democrat who was a child and teenager during the Troubles, and accordingly far less tainted by the legacy of the IRA violence of the 1970s and 1980s (unlike McGuinness and Gerry Adams).

To that end, the DUP is also reportedly rebuffing the Orange Order and hard-line Presbyterian demands to re-open a once-settled issue involving Ulster unionist parade routes designed to provoke Northern Irish republicans. That’s a responsible step, as DUP leaders have made clear their demands from May will be non-sectarian in nature. Though, as Major cautions, English and Scottish voters may well be annoyed at more funds going to Northern Ireland, even Sinn Féin, I suspect, will be happy to see more money from London, given that Brexit means financial support from Brussels will chiefly come to an end (unless funneled through Ireland, whose government, by the way, would balk at picking up the hefty tab that London currently pays, in the unlikely event of unification).

Though the DUP is pro-Brexit, it is in favor of a relatively softer Brexit that keeps Northern Ireland within the EU single market, and it also opposes restoring a hard border with the Republic of Ireland. Given that the border issue is the most delicate and perhaps most intractable surrounding the Article 50 negotiations, the DUP’s input may be helpful. Though DUP officials are reportedly asking May for a pledge not to call a ‘border poll’ over the term of the next government, it’s not clear there’s anything like the sufficiently widespread support today (or in the foreseeable future) for Irish unification to justify May calling such a referendum under the Good Friday framework anyway — though it’s a matter that could arise following a hard Brexit. In the long run, a softer Brexit is far more important to stability and peace in Northern Ireland than any short-term turmoil related to the DUP’s role at Westminster. If both May and Foster exercise caution and restraint, the DUP could help nudge a better outcome for all of Northern Ireland.

In Scotland, the unionists (and Ruth Davidson) strike back

It was the worst night for Scottish nationalism in over a decade — worse, perhaps, than the narrow vote against independence in 2014.

Though the Conservative Party lost its majority at the national level, thanks to a loss of 21 seats in England, it will stagger on as the largest party in the House of Commons thanks in no small part to a surge in support in Scotland, where the party picked up 13 seats, all at the expense of the pro-independence Scottish National Party.

Though the SNP still won a greater share of the vote and more seats than any other party in Scotland, it was a very bad night for the party, which lost more seats, in total, than the Conservatives nation-wide. It was the worst electoral performance for the SNP since 2010 — former SNP leader Alex Salmond lost his seat in Gordon, and deputy SNP leader Angus Robertson lost his seat in Moray. Other MPs, like Mhairi Black, the 22-year-old who is the youngest member of the House of Commons, were easily reelected.

It was a sign, perhaps, that Scottish voters are growing weary of the SNP’s focus on independence after first minister Nicola Sturgeon’s pledge to demand a second referendum on Scotland’s status after Brexit negotiations conclude in 2019. As all three national parties made gains in yesterday’s general election (including what amounts to one-third of the Liberal Democratic caucus in the House of Commons), it leaves Sturgeon and the SNP in a precarious position.

After becoming the indisputable leftist opposition to conservatism in Scotland, the SNP now faces the dual threat of a plausible Tory unionism to its right and a resurgent Labour under an equally left-wing Jeremy Corbyn.

Though Sturgeon won a fresh mandate in the Scottish parliamentary election last May (and will not face voters again until 2021), the SNP’s plurality in the Scottish parliament in Edinburgh falls two seats short of an absolute majority. While the SNP and its allies currently command a majority in favor of calling a second referendum, the 2017 general election result may force Sturgeon to rethink that approach in favor of more quotidian concerns. Moreover, she will have to reorient the SNP approach after it has held power in Scotland since 2007, first under Salmond and, since 2014, Sturgeon. Not an easy task for a party that thought it could keep amassing outsized margins solely by demanding a second referendum.

Sturgeon herself admitted that the ‘referendum-or-bust’ approach may have backfired. Since prime minister Theresa May triggered Article 50 in March, Sturgeon and the Scottish government have demanded a second referendum on independence for Scotland. The region’s voters narrowly chose in September 2014 to stay in the United Kingdom by a margin of 55.3% to 44.7%. The same voters, however, opposed Brexit in the June 2016 EU referendum by a margin of 62% to 38%, joining ‘Remain’ majorities in Northern Ireland and London.

Sturgeon has threatened that if the Brexit negotiations do not leave Scotland with access to the European single market (and a ‘hard’ Brexit would not guarantee that access), Scottish voters deserve the chance to seek independence again as one way to return to the European Union.

Brexit vote is England’s parallel to Scottish independence referendum

Two years ago, you watched as your Scottish brethren to the north held a vote to consider whether to declare independence from the United Kingdom.

When they narrowly voted against independence, you watched as prime minister David Cameron renewed not only the Conservative, but the Labour and Liberal Democratic promise to enact ‘devolution max‘ for Scotland. He also declared, within hours of the vote, that he would seek to prevent Scottish, Welsh and Northern Irish MPs from voting on local English matters in Westminster, thereby correcting the long-discussed West Lothian question. (He managed mostly to annoy Scottish voters, pushing them in even greater numbers to the Scottish National Party and its talented leader, first minister Nicola Sturgeon). As the independence threat receded, however, Cameron failed to follow up on either the Scottish or the English side of the federalism issues that the referendum brought to the fore.

Now imagine that you feel like your fraught middle-class status is threatened — by the global financial crisis of 2008-09 or by the widening scope of inequality or even by the rising tide of immigrants to your community, making it even more difficult to compete for dignified and meaningful work.

Maybe you even decided to abandon the Tories or Labour in the 2015 general election, voting instead for the eurosceptic United Kingdom Independence Party (UKIP) as a way to send a message to Westminster about immigration or globalization. But with the first-past-the-post system, 12.7% of the vote for UKIP translated into just one seat among the 650-member House of Commons. Within England alone, UKIP won an even larger share of the vote (14.1%) than it did nationally. Again, you might have felt that your vote counted for little. Or nothing.

And so, as another referendum approaches this week on whether the United Kingdom should remain a member of the European Union, you might feel doubly disenfranchised. First, to the nameless bureaucrats in Brussels that you believe dictate too much in the way of the laws and policies that govern England. Secondly, within a national political system whose rules minimize third parties and whose leaders have devolved power to all of the regions except, of course, the region where nearly 84% of the population lives: England.

Leaders of the ‘Leave’ campaign make it none too clear that, among their goals is this: Take. Back. Control. Perhaps it’s not coincidental that the parts of the United Kingdom with the greatest amount of regional devolution — London, Scotland, Wales and Northern Ireland — largely support the ‘Remain’ side in the Brexit referendum, according to polls. If ‘Leave’ wins on June 23, there’s a very good chance that it will do so despite the firm opposition of non-English voters.

Nationalists hope to thrive in quiet Welsh elections

Across the United Kingdom, voters will go to the polls Thursday for regional council elections nationwide and to elect regional governments in Scotland, Wales, Northern Ireland and London.United Kingdom Flag Iconwales

Most political attention has focused on London, where Labour’s mayoral candidate, Sadiq Khan, seems set to win by a hearty margin, or more generally on England, where the rest of the Labour Party will be watching to gauge the effects of Jeremy Corbyn’s eight-month leadership.

In Scotland, first minister Nicola Sturgeon’s Scottish Nationalist Party (SNP) is expected to win a landslide victory, with Scottish Labour and the Scottish Conservatives vying for a distant second place.

Above all, voters and politicians are already looking beyond Thursday’s regional and council votes to the European Union referendum on June 23, which could cause national, regional and global tremors.

But Wales is also voting to elect all 60 members of the National Assembly (Cynulliad Cenedlaethol Cymru). Voters choose members directly through constituencies, but vote a second time for a particular party that provides additional seats, on a regional basis, through proportional representation. Though the region has attracted far less attention than Scotland or even Northern Ireland of late, it still boasts 3.1 million residents of its own — a population that’s equal to about 60% of Scotland’s and just 5% of the overall UK population.

As Labour struggles throughout the rest of the country, polls show that the Welsh Labour Party is on track to win Thursday’s vote with ease, which will give Carwyn Jones, the Welsh first minister since December 2009, an easy path to reelection. The center-left Labour, which has historically taken a more nationalist approach to politics in Wales, has won every regional election since 1999, the first in the post-devolution era. Meet the Muslim, 2nd generation Pakistani-British politician set to lead London

When Jeremy Corbyn won the Labour Party’s leadership last September, party stalwarts in London also voted to choose a candidate to contest London’s mayoral election, one of many regional elections taking place on May 5.england_640United Kingdom Flag Icon

Corbyn’s elevation marked the moment when Labour’s rank-and-file members ripped down the curtain on New Labour, ending the party’s two-decade move to the center that kept it in power for three consecutive terms under Tony Blair and Gordon Brown.

But it was perhaps the internal contest to lead Labour into London’s mayoral contest that struck the most damning blow.

The initial frontrunner, Tessa Jowell, pushed London’s bid for the 2012 Summer Olympics as a minister in the Blair government. When London, in fact, won the Olympics, she became the government’s minister for the Olympics as well. Jowell, a ‘Blairite’ long associated with the centrist incrementalism of New Labour, seemed like the perfect fit for one of the world’s financial capitals.

Instead, Labour voters turned to Sadiq Khan, a 45-year-old rising star of Labour’s ‘soft left’ flank. The son of Pakistani immigrants (his mother was a seamstress, his father a bus driver), it’s hard to conceive of a sharper contrast against his opponent, Conservative candidate Zac Goldsmith, the son of a billionaire.

Goldsmith’s father, James Goldsmith, won notoriety in the 1990s for his ‘Referendum Party,’ a eurosceptic forerunner of the United Kingdom Independence Party (UKIP). His son, just 41 years old, wasn’t an implausible candidate for London’s Tories. Like Cameron, Goldsmith is a moderate on social issues, and he is a former writer who spent nearly a decade as the editor of The Ecologist. But he has struggled to contest the image of a wealthy plutocrat out of touch with struggles of everyday Londoners. In April, he struggled to answer several ‘pop quiz’ questions in an interview about the city.

Moreover, Goldsmith’s campaign has been tainted by what even some Conservative critics have called Islamaphobic scare tactics. Those attacks have made Goldsmith seem not only demagogic but also desperate.

What the world can teach the United States about DC voting rights

If you walk through parts of Brasília, it’s hard to believe that it wasn’t modeled, at least architecturally, upon Washington, D.C. when it was built in the late 1950. But when it comes to the voting rights of its capital’s citizens, Brazil has looked beyond the American example.Washington_DC_IconUSflag

Last month, when Brazil held a general election, some 2.5 million voters in the Brazilian Distrito Federal voted for a new governor, eight members to the Chamber of Deputies, the lower house of Brazil’s National Congress, and one of its three members to the Senate, its upper house. In that regard, Brazil’s DF is not unlike any other state in the country. Remarkably, with one deputy per 310,000 residents, that’s a better ratio of representation than the residents of Brazil’s largest state, the far more populous São Paulo.

It’s a typical and unremarkable arrangement around the world, and it’s not unlike Mexico’s Federal District (Mexico City), India’s Delhi Capital Territory and even places with a much more limited history of democracy, including Nigeria’s Federal Capital Territory (Abuja) and Malaysia’s Federal Territory of Kuala Lumpur.

But not in the District of Columbia.

The United States of America, otherwise a beacon of democratic rule for over two centuries, is essentially the North Korea of federal district voting rights, a clear outlier for democratic best practices across the world. Miliband shifts Labour’s focus from austerity to health care

If it wasn’t already clear, Ed Miliband’s final conference speech before next May’s general election indicated that he intends to wage his campaign on the basis of the United Kingdom’s National Health Service — and not a full-scale attack on the ‘austerity’ anti-deficit policies of David Cameron’s coalition government.United Kingdom Flag Icon

It’s hard to believe that Miliband has now been the leader of the United Kingdom’s Labour Party one year longer than former  prime minister Gordon Brown was, especially after the bravura performance that Brown delivered for the ‘Better Together’ campaign, which may have swayed enough Scottish voters to reject independence in the surprisingly close referendum.

When he won the leadership in September 2010, upsetting his opponent and brother, former foreign minister David Miliband, it was a shock. While Labour’s MPs and the party faithful narrowly preferred David, unions and other affiliated Labour groups gave Ed just enough of an edge to narrowly defeat the more seasoned Miliband, who promptly left frontline politics and moved to New York.

In the past four years, Ed Miliband has benefitted from the polling lead that Labour has consistently held against the Conservatives, who have been mired in unpopular decisions to slash the national budget after years of more permissive spending under Brown and his predecessor Tony Blair, for whom Brown served as chancellor of the exchequer.

In the first year of Tory-led government, the British economy grew by 1.7% — sluggish in absolute terms, but vigorous by what would follow. In 2012, British GDP fell to 0.3% before rebounding last year to 1.7% and a forecasted growth rate of 3.2% in 2014.

As the economy has improved, it means that it might not be enough for Miliband to attack Cameron and the current chancellor, George Osborne, for inflicting greater damage on the economy by cutting spending in a time of low economic growth. While it may be true that Osborne’s budget cuts didn’t necessarily promote growth, it’s unavoidable fact that the United Kingdom is now growing faster than the rest of the European Union, which emerged from the 2008-09 global financial crisis and the 2010-12 eurozone debt crisis to face a growing deflation threat today. Italy, which has struggled to enact reforms under its energetic new prime minister Matteo Renzi, recently entered a triple-dip recession.

Polls, meanwhile, show an increasingly tight race. Labour’s once dominant lead is shrinking, in the most recent September 18-19 YouGov/Sunday Times poll to just 4%. If the election were held today, Labour would edge out the Tories by a margin of 36% to 32%, with the eurosceptic United Kingdom Independence Party (UKIP) winning 16% and the junior coalition partners, the Liberal Democrats, just 7%. That could result in any number of outcomes, including a Labour minority government, a Conservative minority government, or the continuation of the Tory-Liberal Democratic coalition.

That goes a long way in explaining why Miliband is increasingly shifting from an anti-austerity message to a campaign that places greater funding for an increasingly burdened National Health Service (NHS) at the heart of his bid to defeat Cameron in eight months’ time. Scottish referendum results: winners and losers

Scottish residents — and all British citizens — will wake up today to find that, however narrowly, the United Kingdom will remain as united today as it was yesterday, from a formal standpoint.

With all 32 local councils reporting, the ‘Yes’ camp has won 1.618 million votes (44.7% of the vote) against 2.002 million votes (55.3% of the vote) in favor of remaining within the British union, capping a 19-month campaign that resulted in a staggering 84.6% turnout in Thursday’s vote.

Moreover, ‘Yes’ won four councils, including Glasgow, Scotland’s largest city:

But the close call has shaken the fundamental constitutional structure of the United Kingdom, and Scotland’s vote will now dominate the political agenda in the final eight months before the entire country votes in a general election next May, for better or worse.

So who comes out of the referendum’s marathon campaign looking better? Who comes out of the campaign bruised? Here’s Suffragio‘s tally of the winners and losers, following what must be one of the most historic elections of the 2010s in one of the world’s oldest democracies.

One of the biggest carrots that the ‘Better Together’ campaign is dangling to undecided voters in the week before tomorrow’s Scottish independence referendum is the concept of ‘devo-max’ — the idea that London will deliver ever greater devolution of policymaking powers to the Scottish parliament in Holyrood.United Kingdom Flag Iconscotland

Conservative prime minister David Cameron, Liberal Democratic deputy prime minister Nick Clegg and Labour leader Ed Miliband on Tuesday together signed a high-profile pledge to give Scotland greater powers, even without reducing the amount of financial support Scotland currently receives from Westminster.

That is, of course, if Scots vote ‘No’ to independence.

It’s a vow that nationalist leaders, including Scottish first minister Alex Salmond, were quick to dismiss as last-minute gasps of desperation not to be trusted. Salmond, among others, noted that it was Cameron’s insistence on a straight in-or-out vote that eliminated a possible third option for a more federal United Kingdom or some form of devo-max when the two leaders agreed the referendum in March 2013.

Former Labour prime minister Gordon Brown has argued for months that a ‘No’ vote would necessarily require a debate over additional devolution. It might have been strategically wiser if British party leaders, as well as the leaders of the ‘Better Together’ campaign like former Labour chancellor Alistair Darling, had acknowledged the devo-max option earlier. That may be one reason why Brown, who engineered Scottish devolution upon Labour’s 1997 electoral victory, has emerged as such a strong champion for the ‘No’ campaign, despite his national defeat in the 2010 general election. His speech today, less than 24 hours before polls open, was one of the best of the campaign (on either side) and maybe the best of his career.

If a ‘Yes’ vote could endanger Cameron’s premiership, a ‘No’ vote tomorrow could alter Brown’s legacy for the positive.

But as politicians from the left and the right have descended upon Scotland in the last week, with polls showing a much tighter contest than the anti-independence campaign ever anticipated, it’s worth considering three questions about the latest promise of further devolution:

  • Has Scotland effectively used its local governance powers in the past 15 years?
  • What additional powers might Scotland be granted as part of ‘devo-max’?
  • With a general election approaching in May 2015, and with the governing Conservative base firmly rooted in England, is the promise of devo-max something Cameron can legitimately deliver, in light of grumbling from English Tories increasingly frustrated about concessions to Scotland?

Hey! What about gay marriage in Scotland and Northern Ireland?

Amid the fanfare that much of the United Kingdom would now enjoy full same-sex marriage rights following the success of Conservative UK prime minister David Cameron in enacting a successful vote earlier this week in Parliament, some LGBT activists are still waiting at the altar of public policy for their respective day of celebration.United Kingdom Flag Iconscotlandnorthernireland

Under the odd devolved system within the United Kingdom of Northern Ireland and Great Britain, it’s up to the separate Northern Ireland Assembly to effect its own laws on marriage.  Even within Great Britain, the Scottish parliament, likewise, has the sole power to enact legislation related to marriage rights.

So while nearly 90% of the residents of the country will now be able to enter into same-sex marriages, Scottish and the Northern Irish will have to wait a little longer — and in the case of Northern Ireland, it seems like the wait will be lengthy. Scotland, with 5.3 million people (8.4% of the total UK population), and which will vote on independence in a referendum in September 2014, is already taking steps toward passing legislation, though Northern Ireland, with 1.8 million people (2.9% of the UK population), has already considered and rejected same-sex marriage.

The reason for the disparity within the United Kingdom goes back to former Labour prime minister Tony Blair.

Under the broad devolution process that his ‘New Labour’ government initiated upon taking power in 1997, much of the power to regulate life in Scotland was devolved from Westminster to the new parliament that met for the first time in 1999 at Holyrood.  Although a parallel Welsh Assembly exists in Cardiff for Welsh affairs, the Welsh parliament lacks the same breadth of powers that the Scottish parliament enjoys, which is why the Welsh now have same-sex marriage rights. (Take heart, Daffyd!)

Northern Ireland has a similar arrangement, with its own devolved Northern Ireland Assembly at Stormont, though its powers were suspended from 2002 to 2007 when the Northern Ireland peace process fell apart, however briefly.

The disparate courses of English, Scottish and Northern Irish marriage rights are a case study in how devolution works in the United Kingdom today.

Scotland: Holyrood poised to pass an even stronger marriage equality bill in 2014

Scotland’s local government, led by Alex Salmond and the Scottish National Party, introduced a same-sex marriage bill late in June that is set to provide an even more liberal regime of marriage rights.  While the marriage bill passed earlier this week in London actually bans the Anglican Church of England from offering same-sex marriage ceremonies, the Scottish bill won’t have the same prohibitions on the Presbyterian Church of Scotland, which is seen as somewhat more relaxed about gay marriage.  Like the English legislation, however, the Scottish bill offer protections to ministers on religious grounds who do not choose to officiate same-sex marriages.

Although there’s opposition to the bill within the governing SNP as well as the Scottish Labour Party and the Scottish Liberal Democratic Party, the Conservative Party has very little influence outside England and Scotland, generally speaking, is even more socially progressive than England, which means that the legislation is widely expect to pass in the Scottish Parliament early next year, with the first same-sex marriages in Scotland to take place in 2015.

Northern Ireland: gay marriage as a football between Protestant and Catholic communities

Earlier this year, the Northern Ireland Assembly considered a same-sex marriage bill, but it was defeated in April by a vote of 53 to 42 — a similar motion was defeated in October 2012 by a similar margin. Since 2005, LGBT individuals have been able to enter into civil partnerships (with most, though not all, of the rights of marriage enjoyed by opposite-sex partners) throughout the entire United Kingdom, including Northern Ireland.

When Scotland passes its gay marriage bill next year, however, it will leave Northern Ireland as the only part of the United Kingdom without marriage equality.

Not surprisingly, given that Northern Ireland was partitioned out of the Republic of Ireland in 1921 largely on religious lines, and Protestant-Catholic violence has plagued Northern Ireland for much of the decades since, Northern Ireland is the most religious part of the United Kingdom.  A 2007 poll showed that while only 14% of the English and 18% of Scots were weekly churchgoers, fully 45% of the Northern Irish attended church weekly.

Unlike Scotland, where the mainstream UK political parties, such as the Tories, Labour and Liberal Democrats, aim to compete with the Scottish Nationalists (with varying degrees of success), Northern Irish politics are entirely different, based instead on the largely Protestant ‘unionist’ community and the largely Catholic ‘nationalist’ community.  Around 41% of Northern Ireland is Roman Catholic, while around 41.5% of Northern Ireland is Protestant (mostly the Presbyterian Church and the Anglican Church of Ireland).

That helps explain why the opposition to gay marriage in Northern Ireland remains so strong, and it doesn’t help that the issue falls along the same lines as the entrenched unionist and nationalist divisions.  Given that it’s unlikely either community will come to dominate Northern Irish politics and the Assembly anytime soon, it means that proponents of same-sex marriage will have to convince at least some unionists to join forces with largely supportive nationalist parties to pass a marriage bill — and that may prove a difficult task for a five-way power-sharing government in Belfast that has enough difficulties even without gay marriage.  Continue reading Hey! Scots to vote on independence in 2014 as Salmond and Cameron seal referendum pact

They’ve certainly screwed their courage to the sticking place now.

UK prime minister David Cameron has agreed with Scotland’s first minister Alex Salmond on the terms of a referendum, to be held in Scotland in autumn 2014, as to whether Scotland should seek independence or remain part of the United Kingdom of Great Britain and Northern Ireland.

With a newly elected sovereigntist government in the French-speaking province of Québec in Canada, and with the separatist-minded Basque Country set for regional elections this Sunday and the even more separatist-minded Catalunya going to regional polls next month, regional autonomy seems to be mounting somewhat of a comeback on both sides of the Atlantic.

Under today’s ‘Edinburgh agreement’ between Salmond and Cameron, Scottish voters will have the opportunity to vote for independence, ending 305 years as a single nation united with England after the 1707 Act of Union.

The agreement marks a tactical victory for both Salmond and Cameron.  Salmond, who had hoped to put off the referendum indefinitely and perhaps beyond the next scheduled general election in 2015, will nonetheless get a delay for nearly two years to make his case for independence, and 16- and 17-year olds will be permitted to vote as well (so 14-year-old Scots, start following Suffragio now).

For his part, Cameron will have succeeded in getting a straight up-and-down vote on the independence question, not a multiple-question referendum on greater autonomy for Scotland, which polls show would be much more likely to succeed than full independence.

Salmond, who is Scotland’s ‘first minister’ — the leader of the regional Scottish government — and whose Scottish National Party in 2011 secured the largest mandate of any regional Scottish election since the 1998 devolution established the Scottish parliament, will lead the campaign for the ‘yes’ vote.

Cameron, the Tory prime minister who won just one seat and a grand total of 16.7% in the 2010 general election in Scotland (finishing last among the four major parties), will lead the campaign for the ‘no’ vote, but he will certainly be joined by Labour leader Ed Miliband and Liberal Democratic leader and deputy prime minister Nick Clegg, whose party serves in the United Kingdom’s governing coalition with the Tories. Since the days of former prime minister Margaret Thatcher, who tried to use Scotland in 1989 as a testing ground for the much-derided ‘poll tax’ that was set to apply nationwide in 1990, Scotland has greeted the Tories with antipathy.  So it’s not without some legitimacy that Miliband has argued that only Labour can keep Scotland in the United Kingdom.

As Alex Massie writes for The Spectator, in calling the entire ‘phony war’ leading up to today’s event  a queer process (and quite rightly), he notes that Cameron himself, quite a fish out of water in Scotland, may lose the general election currently scheduled for May 2015:

David Cameron slinks in to Scotland almost as though he were the leader of a foreign country already. You would not think he’s merely visiting territory for which he presently holds some responsibility. The optics – as the media handlers say – will favour Mr Salmond today. Why, there will even be signing and swapping of papers further bolstering the impression this is a meeting of equals….

The difficulty is that it is not yet clear what a No vote actually means. It will not necessarily settle the matter, not least since the Prime Minister is on record as being open to “more powers” for Holyrood after the referendum.

That, however, is a discussion upon which he may have little influence. The next Westminster election must be held just six months or so after Scotland’s referendum. David Cameron may – just may – not win that election. Which means that at some point we will need to know what Ed Miliband thinks about Scotland too. What a happy thought that is!

On the surface, then, Salmond seems well placed in the next 24 months to turn around polling data that shows, on a straight ‘union vs. independence’ referendum, Scots support union (as of an Oct. 8 TNS-MRNB poll) by a 53% margin, to just 28% in favor of breaking from the United Kingdom.

Scotland, under Labour prime minister Tony Blair’s devolution policy for Scotland, Wales and Northern Ireland, achieved its own parliament after a successful 1997 referendum, and the Scottish parliament came into being in 1998.  The parliament, informally known as Holyrood, the name of the Edinburgh neighborhood in which it is located, is a 129-member unicameral legislature, essentially shares legislation power with the UK parliament in Westminster.

Cameron’s victory in the ‘Edinburgh agreement’ was to limit the options to strictly independence or remaining in the union, rather than allowing for a ‘devomax’ option — maximum devolution that would provide the Scottish parliament even more powers currently reserved for Westminster.  Indeed, Cameron seemed to dangle the possibility of further devolution earlier Tuesday in his remarks on the agreement:

Mr Cameron said: “All those who want to see not only the status quo but further devolution from the United Kingdom to Scotland must vote to stay within the United Kingdom.  Then it’ll be for all the parties to decide what proposals to put forward, but I’ve always taken the view we have to answer this prior question first. We have to answer the question: does Scotland want to stay in the United Kingdom? If the answer is Yes we do want to stay in the United Kingdom, then obviously further devolution is possible.”

In some senses, though, the limitation to a simple yes-or-no vote raises the stakes — Scots will be bloody well certain to demand guarantees from the parties supporting the ‘No’ vote that additional devolution will result from a successful ‘No’ vote in 2014.   Continue reading Scots to vote on independence in 2014 as Salmond and Cameron seal referendum pact
