Vučić easily wins presidential victory to consolidate power across Serbia’s government

For decades, presidential politics in parliamentary democracies were boring affairs — if popular elections were even held for the position, they typically featured technocrats or independents. Politicians, if they ran for what are mostly ceremonial presidencies, would be episodes that ended a successful political career.  

That’s still generally the case in western Europe — presidents like former Labour firebrand Michael D. Higgins in Ireland, one-time foreign minister Frank-Walter Steinmeier in Germany, and the charismatic communist Giorgio Napolitano in Italy all ended (or are ending) their political careers as figureheads.

But increasingly, in emerging democracies in eastern Europe, it’s becoming a power play for popular prime ministers to wage campaigns for a previously ceremonial presidency, using the ‘mandate’ of popular election as a bid to suffuse the presidency with far more than ceremonial power.

It is a gambit that’s worked in the Czech Republic and in Turkey, where presidents Miloš Zeman (since 2013) and Recep Tayyip Erdoğan (since 2014) have succeeded, to some degree, in shifting some power from the parliamentary branch of government to the presidential. The Czech Republic remains a parliamentary democracy, but Zeman, who is running for reelection in 2018, shrewdly took advantage of the country’s first direct presidential elections to carve a new role for the Czech presidency in domestic and foreign policymaking. Erdoğan not only won the Turkish presidency, but hopes to formalize constitutional changes to enshrine presidential power in a high-stakes April 16 referendum.

It failed in Slovakia, where sitting prime minister Robert Fico lost the 2014 presidential election to independent businessman and philanthropist Andrej Kiska. So it’s a power move that can sometimes backfire — Fico managed to remain Slovakian prime minister, but his center-left party dropped from 83 seats to 49 in the National Assembly in last March’s parliamentary elections after a swing of 16% away from Fico’s party.

There will be no such regrets for prime minister Aleksandar Vučić, who easily won a first-round victory with 55% of the vote among an 11-candidate field, cementing control of the Serbian government not only in the hands of the ruling Serbian Progressive Party (Српска напредна странка / SNS), but, in particular, under the personal command of Vučić, who nudged incumbent Tomislav Nikolić to stand aside from a reelection bid in late February.

It will make Vučić even more powerful than Boris Tadić, a center-left and pro-EU leader who similarly dominated Serbian politics as president from 2004 to 2012. Though Nikolić narrowly defeated Tadić five years ago in a runoff, Vučić (and not Nikolić) held more sway over Serbian government over the last half-decade, increasing his grip on power over a series of three parliamentary elections between 2012 and 2016. Vučić’s presidential victory means that power is now likely to swing (once again) to the Novi Dvor, the Serbian presidential palace.

Over the next two months, as he prepares to take the presidential oath on May 31, Vučić, who remains prime minister for the time being, is likely to choose one of several cabinet members as his successor — leading names include two independents appointed by Vučić to his cabinet, finance minister Dušan Vujović or public administration minister Ana Brnabić (who would not only be Serbia’s first female prime minister, but its first openly lesbian one, too). Nikolić, over the weekend, hinted that he would retire from party politics altogether, which would seem to eliminate him as prime minister. Indeed, few elections were more consequential in 2015 than the landmark vote in Myanmar, the country’s first freely open democratic election after a decades-long fight by activist Aung San Suu Kyi, a daughter of one of the country’s founding fathers, who began fighting to open Burmese political space in the early 1990s. The most outward consequence of that victory was Tuesday’s election of a new president, and the majority commanded by Suu Kyi’s National League for Democracy (NLD) meant that it could essential name the president.

With one exception. The most obvious choice, Suu Kyi, by far the country’s most popular figure, is barred from running because of a constitutional technicality. Instead, electors chose the next best thing: a close ally and friend fighting alongside Suu Kyi for decades.

Accordingly, Myanmar’s new president — and its first truly civilian president after a half-decade of military rule — is Htin Kyaw.

A 69-year-old British-educated computer sciences expert and author, Htin Kyaw was a civil servant in the 1980s before joining Suu Kyi’s democratic crusade. A longtime intimate of the Nobel peace laureate, he made it immediately clear upon his election that it would be Suu Kyi calling the shots in the new government. Suu Kyi herself has said that she will be ‘above the presidency,’ though she may yet take a role, such as foreign minister, in the new government. Four foreign policy arguments Sanders could still deploy against Clinton

If there’s one thing we know about Bernie Sanders, he sure doesn’t like Henry Kissinger.USflag

And if there’s one fact that he likes to deploy in his foreign policy case against Hillary Clinton, it’s her vote authorizing the Iraq War 14 years ago, when Clinton was just in her second year as a senator from New York.

But aside from the Kissinger snark and some minor back-and-forth over US policy in Cuba, foreign policy played only a little role in Wednesday night’s Democratic presidential debate, and it’s played an equally minor role throughout the entire contest. On one hand, that’s because the Sanders insurgency has zeroed in on income inequality, the growing wealth gap and the role of wealthy donors in campaign finance. But it’s also because Clinton, whether or not you trust her judgment, is the most qualified non-incumbent candidate in decades when it comes to international affairs. In addition to her service in the US senate, she also served for four years as secretary of state and eight years as first lady. It’s truly formidable.

Yet, given Clinton-Sanders dynamic, there’s still a lot of space for Sanders to make a strong foreign policy case against Clinton, and time after time, Sanders just hasn’t made that case. Maybe that’s politically wise; shifting his emphasis from Wall Street and income inequality would dilute his message with an attack based on issues that seem far less salient to Democratic primary voters.

But it’s true that Clinton’s foreign-policy instincts have always been more hawkish than those in her own party and, often, those of president Barack Obama and vice president Joe Biden (who, according to Jeffrey Goldberg’s amazing piece in The Atlantic about Obama’s world view, said Clinton ‘just wants to be Golda Meir’).

To some degree, the problem with challenging Clinton on foreign policy is that Sanders would largely be challenging the Obama administration, and that’s tricky when you’re trying to win the votes of an electorate that still adores Obama. But Sanders certainly hasn’t shied away from stating clear differences with the Obama administration’s approach to domestic policy.

Moreover, to the extent that Sanders made a clear and cogent case on international affairs, he could claim that his more dovish approach represents true continuity with the Obama administration (and that Clinton’s more hawkish approach shares more in common with a  potential Republican administration). There’s no doubt that Sanders is a talented politician; in one fell swoop, he could use foreign policy to drive a wedge between Clinton and the Obama legacy. That’s a very powerful tool, and it’s one that Sanders, so far, hasn’t been interested in wielding.

Fairly or unfairly, Sanders is tagged as a one-issue protest candidate, and he suffers from the perception that his candidacy’s purpose is to nudge Clinton further to the left, not to win the Oval Office. By adding a foreign policy element to his critique of the Democratic frontrunner, Sanders could bend a more skeptical media into taking him more seriously and show voters that he really can fill out what Americans expect from a president. In the 21st century, like it or not, the president is the chief policymaking official when it comes to foreign policy.

Given the stakes involved, it’s not too late for Sanders to make this case as the Democratic contest turns to larger states like Ohio, Illinois and Florida next week and, after that, Pennsylvania, New York, New Jersey and California. If he wanted to do so, there’s a long list of areas from which Sanders could choose.

What is Nigerian candidate Buhari really doing in London?

Since last weekend, leading Nigerian presidential challenger Muhammadu Buhari has been in London, even though he’s waging a spirited fight in what could easily be the most contested election since the return of civilian rule in 1999.nigeria_flag_icon

So what was he doing spending a week in the United Kingdom, over 4,200 miles away?

Buhari, the candidate of the opposition All Progressives Congress (APC), who’s waging his fourth presidential campaign since 2003, was also Nigeria’s military head of state between December 1983 and August 1985 has been in the United Kingdom, waging a charm campaign that seems largely geared at allaying fears of Western government, specifically those of the United Kingdom and the United States, that a Buhari victory in Nigeria’s delayed March 28 election would represent a backtrack for democracy in Africa’s most-populous country and its largest economy.

He appeared at the leading think tank, Chatham House, in London on Thursday.

Though it was clear that his audience was Western policymakers and not Nigerian voters, Buhari’s remarks, at least at face value, were humble, measured and thoughtful, and he committed himself to democracy, not only in Nigeria but throughout Africa, expressing hope that a flourishing, democratic Nigeria could trigger a wave of consolidated democratization throughout Africa. Buhari’s victory could end, after 16 years, the dominance of the governing People’s Democratic Party (PDP) in Nigeria.

He spoke, sometimes eloquently, about how democratic elections alone are not enough to entrench democratic traditions in Africa.

As you all know, Nigeria’s fourth republic is in its 16th year, and this election will be the fifth in a row. This is a major sign of progress for us, given that our first republic lasted three years and five months. The second republic ended after four years and two months.

And the third republic was a stillbirth.

That last bit elicited laughter from the audience, because it was Buhari who led the military coup that brought the third Nigerian republic to its end three decades ago.

But Buhari ended his remarks by addressing his own baggage, the most controversial aspect of his candidacy. As Nigeria’s military head of state in the 1980s, Buhari led the coup that deposed Nigeria’s first elected president and subsequently governed in ways that violated human rights principles:

Let me close this discussion on a personal note. I have heard and read references to me as a former dictator in many respected British newspapers, including the well-regarded Economist. Let me say, without sounding defensive, that dictatorship was military rule. Though some are less dictatorial than others, I take responsibility for whatever happened on my government watch. I cannot change to the past, but I can change the present and the future. So before you is a former military ruler and a converted democrat.

Frankly, that’s a lot more apologetic than South Korean president Park Guen-hye, who only reluctantly expressed regret for the excesses of her father, South Korea’s military dictator for nearly two decades. Indian prime minister Narendra Modi hasn’t apologized at all for more than 1,000 Muslim killed in riots that took place in Gujarat in 2002, when Modi’s state government was accused of encouraging Hindus to take vigilante action.

Though Nigeria’s sporadic military rule firmly ended in 1999, its first ‘civilian’ president, Olusegun Obasanjo, was a Nigerian army general and his administration, which ended in 2007, found many top roles for Obasanjo’s former military pals. No one today could call Buhari, three decades after his own role in toppling an elected Nigerian president, a figure who wants to restore military rule. Ironically, perhaps, Nigeria’s military brass today generally favors the incumbent, Goodluck Jonathan, and Buhari, a northern Muslim with a reputation as something of an ascetic who tried to reduce corruption in the 1980s, could upset the cozy links between Nigerian business and government.

But Western governments, which have worked closely with Jonathan since he assumed the presidency in 2010, have been wary of Buhari, questioning what his checkered past would mean in the event that he defeats Jonathan — a result that seems quite possible, according to ground reports and to polls.

Hong Kong: One country, one-and-a-half systems?

Normally, an unofficially referendum conducted online isn’t worth paying much attention — just ask the residents of Venice who organized a deeply flawed, overwrought poll on Venetian independence that attracted just 135,000 participants after initially claiming 2.4 million.Hong Kong Flag IconChina Flag Icon

But it’s worth noting the ongoing online referendum that the Hong Kong-based ‘Occupy Central with Love and Peace’ has organized, because it’s one element of a larger struggle between democracy activists and Beijing that could have major repercussions — not only for Hong Kong, but for the future political development of Macau, the Chinese mainland and, possibly, Taiwan.

Occupy Central’s chief goal is to open the nominating process for the 2017 election of Hong Kong’s chief executive. Hong Kong’s Basic Law, promulgated prior to the 1997 handover to govern the Hong Kong special administrative region, provides for the eventual democratic election of a chief executive. It’s a development that dates back over two decades to the negotiations between the British and Chinese governments over the 1997 handover. Ten years ago, Chinese officials finally relented and committed to some form of universal suffrage for the 2017 race.

Trouble began brewing earlier this month, however, when Beijing released a provocative ‘white paper’ on Hong Kong that took an aggressive posture with respect to Hong Kong’s future:

Published by the State Council Information Office, the unprecedented white paper states that “many wrong views are currently rife in Hong Kong” with regard to the “one country, two systems” principle that governs the territory’s relationship with Beijing. Some residents are “confused or lopsided in their understanding” of the principle, it adds.

“The high degree of autonomy of the HKSAR (Hong Kong Special Administrative Region) is not full autonomy, nor a decentralized power,” said the paper. “It is the power to run local affairs as authorized by the central leadership.”

Local media have gone so far as to describe the white paper as an outright repudiation of the ‘one country, two systems’ principle that has guided China-Hong Kong relations since Deng Xiaoping (邓小平) coined the concept in the 1980s during the initial handover negotiations. Would ‘lottocracy’ be a better form of government than democracy?

Winston Churchill is attributed with the quote, ‘Democracy is the worst form of government, except for all those others that have been tried.’

But it’s William F. Buckley who said, ‘I am obliged to confess I should sooner live in a society governed by the first two thousand names in the Boston telephone directory than in a society governed by the two thousand faculty members of Harvard University.’

Alex Guerrero, assistant professor of philosophy, medical ethics and health policy at the University of Pennsylvania (and also a law school classmate of mine), thinks Buckley may have been on to something, and he makes the case for selecting representatives not by elections, but through a lottery system in Aeon today:

First, rather than having a single, generalist legislature such as the United States Congress, the legislative function would be fulfilled by many different single-issue legislatures (each one focusing on, for example, just agriculture or health care). There might be 20 or 25 of these single-issue legislatures, perhaps borrowing existing divisions in legislative committees or administrative agencies: agriculture, commerce and consumer protection, education, energy, health and human services, housing and urban development, immigration, labour, transportation, etc.

These single-issue legislatures would be chosen by lottery from the political jurisdiction, with each single-issue legislature consisting of 300 people. Each person chosen would serve for a three-year term. Terms would be staggered so that each year 100 new people begin, and 100 people finish. All adult citizens in the political jurisdiction would be eligible to be selected. People would not be required to serve if selected, but the financial incentive would be significant, efforts would be made to accommodate family and work schedules, and the civic culture might need to be developed so that serving is seen as a significant civic duty and honour.

At first read, it sounds like a nightmare out of an Arthur Miller play.  Three hundred random US citizens would congregate to tackle a discrete issue like climate change, health care reform, or immigration reform.

What’s so bad about democracy? 

Before you dismiss the idea outright, it’s important to bear in mind the long, long list of problems with elections, in their current form in the United States and in other mature democracies — and that’s saying nothing about the question of free and fair elections in countries where democratic institutions are less robust.  The business of policymaking of a typical 21st century government is typically too complex for direct democracy to thrive in most jurisdictions. The need to become informed about the nuances of even major policy decisions would quickly overwhelm all of us.  Experiments with direct democracy, through the proliferation of ballot initiatives to decide key issues, have worked better in some places (Switzerland) than in others (California).  The limitations of direct democracy have meant that, outside the classical era of Athenian democracy and a few referendum-driven jurisdictions, ‘democracy’ for most people today means representative democracy.  Voters elect legislators and executives on the basis of a plethora of policy positions.

Of course, by gaining efficiency, indirect democracies lose precision — voters will choose one candidate over another for many reasons, and no voter’s policy priorities may line up entirely with any candidate.

Moreover, we can see the other problems of representative democracy in modern US politics.  Marketing and advertising, since at least the onset of the television era, can now be more important than policy positions.  Accordingly, representatives spend more time today raising money from donors than tending to the business of lawmaking, undermining the one-person-one-vote principle that undergirds representative democracy.  As Alex notes, the current process is subject to all sorts of problems.  The influence of money and lobbyists can lead to agency and electoral capture.  Collective action problems are rife — interest groups who care deeply about an issue can skew policies to their favor, even at the expense of the widely dispersed gains that might otherwise accrue to the rest of the population.  Protectionism, tariffs and free trade is a classic example.

Gerrymandering, barriers to entry and the advantages of incumbency massively reduce competition within the political marketplace.  It’s left us with a system where, as Alex writes, ’44 per cent of US Congresspersons have a net worth of more than $1 million; 82 per cent are male; 86 per cent are white, and more than half are lawyers or bankers.’ It’s a system where Congressional reelection rates in the United States routinely exceed 90% — even in a massive ‘wave’ election like the 2010 midterms that saw a Republican wave, the reelection rate was still 85%.  Part of that you can blame on gerrymandering, but more so on the natural preferences and geopolitical distribution of urban and rural voters — and perhaps even more so on the US electoral system (i.e., single-member plurality districts instead of proportional representation).  

Tradition, financial and political infrastructure, a first-past-the-post electoral system and path dependence mean that, in the United States, two political parties reign supreme.  When those two parties agree on policy preferences, it means there’s effectively no competition within the political marketplace on many key issues — in the past three decades, this has included drug legislation, foreign policy, national security, military affairs, gun regulation, financial regulation, home ownership policy and other matters.  In many cases, the bipartisan consensus has turned out to be wrong.

Electoral competition, too, is rife with short-term thinking.  In a world where public servants are focused on reelection in two years (the US House of Representatives), four years (the US president) or six years (the US Senate), there will always be a temptation to focus on short-term benefits at the expense of long-term costs.  Say what you want about the People’s Republic of China, but the governing Chinese Communist Party has to contemplate long-term effects of its policies, because there’s no alternative party to blame.  In the US system, Democrats and Republicans can rotate in and out of office and blame each other for perpetuity.  Not so in China — the CCP has to own its policy decisions or face a massive popular revolt.

That all assumes, too, that voters make well-informed, rational decisions.  As Bryan Caplan argues in The Myth of the Rational Voter: How Democracies Choose Bad Policies, borrowing from the insights of economic theory, ‘democracy’ fails primarily due to irrational and ill-informed voters:

In the naive public-interest view, democracy works because it does what voters want.  In the view of most democracy skeptics, it fails because it does not do what voters want.  In my view, democracy fails because it does what voters want.  In economic jargon, democracy has a built-in externality.  An irrational voter does not hurt only himself.  He also hurts everyone who is, as a result of his irrationality, more likely to live under misguided policies.  Since most of the cost of voter irrationality is external — paid for by other people, why not indulge?  If enough voters think this way, socially injurious policies win by popular demand.

It’s also worth asking how truly ‘democratic’ elections have become.  Since the 20th century, government has become so complex that many policy decisions are two steps removed from the ballot box, with legislators ceding control to specialized regulators.  In the United States, the wide-ranging administrative and regulatory state nearly amounts to a fourth, unelected branch of government.  Critics of the European Union have long pointed to a ‘democratic deficit’ within the growing EU institutions.  Despite a growing role for the elected European Parliament and perhaps a more representative era in selecting the European Commission, the key decisions of European integration (including the creation of the single market and monetary union) were made more by treaty than at the ballot box.

Despite Zimbabwe, sub-Saharan Africa is becoming more democratic, not less

African legal scholar Andrew Novak and I make the case at Reuters today that despite the reelection of Robert Mugabe in Zimbabwe, sub-Saharan Africa is making gains with respect to democracy, and we examine the eight countries with elections between mid-July and September 30 alone (though as of earlier this week, Madagascar seems to be postponed until later this year).madagascar-flagMali Flag Iconzimbabwe new icon

We look to three catalysts in particular:

Recent African elections demonstrate progress in three ways.  First, long-delayed or boycotted elections are finally taking place, removing military regimes or one-party states from power.

Second, for the first time, several countries having enjoyed two or three free and fair elections in a row. This is significant because running two well-managed elections improves the odds that there will be a third, and then a fourth — turning an isolated electoral experiment into a true democratic tradition.

Third, elections once marred by violence have been carried out peacefully, improving the credibility of political leaders and encouraging coalition-building and a non-zero sum attitude toward governing.

So for every Zimbabwe, there’s a Mali, which represents a return to two decades of democratic traditions.  There’s a Kenya, where president Uhuru Kenyatta’s election earlier this spring wasn’t marred by violence, despite a close race.  There’s a Guinea, where long-delayed elections are moving forward after fraught negotiations between the ruling party and the opposition.  Even in Zimbabwe, July’s elections passed without the violence that resulted in 2008, and Mugabe’s successor will likely have to be much more responsive to economic and social pressures than Mugabe, who too often gets a free pass from Zimbabweans and other Africans due to his founding-father status in leading the country out of white minority rule in 1979-80.

Our conclusion is that there’s room for measured optimism:

It would be a mistake to view the developing African democracy with the same kind of rapture than some international investors have developed in recent years for Africa’s “cheetah” economies.  But in the wake of international discouragement over Zimbabwe’s vote, it would also be a mistake to conclude that African democracy is in retreat, when there are so many signs that it continues to grow stronger.

Why fears about the return of the PRI to power in Mexico are wrong

Jo Tuckman had an engaging piece in The New York Times on Sunday, decrying the “lost years” of Mexican democracy and sounding some alarm about the likely return to power in Mexico of the Partido Revolucionario Institucional (PRI) when Enrique Peña Nieto, as widely predicted, wins the presidential election on July 1.

She asks:

How is it, then, that the party’s candidate, Enrique Peña Nieto, seems poised to win the presidential election next Sunday and become the leader of 113 million Mexicans?

The answer is that Peña Nieto has run a much (much) superior campaign than Josefina Vázquez Mota, the candidate of the Partido Acción Nacional (PAN) or Andrés Manuel López Obrador, the candidate of the Partido de la Revolución Democrática (PRD).  The PAN has held the presidency for 12 consecutive years, so it has taken the brunt of criticism over the Mexican economy, drug violence and the less-than-galloping pace of political and economic reform, even though it doesn’t control Congress, and the PRI and the PRD have opposed most of president Felipe Calderón’s agenda.  For its own part, the PRD still isn’t truly a political presence in northern Mexico and López Obrador blew a huge lead in the 2006 presidential election and refused to cede the PRD’s shot in 2012 to the younger and more centrist Marcelo Ebrard.

The PRI, of course, governed Mexico from 1929 until 2000, often with a healthy dose of authoritarianism, an even healthier dose of electoral fraud and a lot of government spending diverted to bolstering the party.  For most of the PRI’s reign, it’s safe to say, Mexico was something short of a strict dictatorship (Mexico’s government had certain features that limited authoritarian abuse, such as a six-year term limit for Mexican presidents), but nothing like a liberal democracy.

But Tuckman is wrong to call the last 12 years a lost opportunity, and she’s wrong that the impending return of the PRI indicates that Mexican democracy is in danger — if anything, the PRI’s return indicates that Mexican democracy is thriving.

It would be prudent, of course, for Mexican civil society to remain vigilant for any signs of backsliding, and groups, such as the youthful YoSoy132 movement, are pressing this very point within Mexico.  As it turns out, Televisa, Mexico’s largest television network, had been selling favorable coverage to Peña Nieto — in years past, the PRI may have gotten away with that; instead, it was plastered earlier this month across global headlines when The Guardian broke the scandal (back in 2000, Mexico’s oil company, Pemex, gave $140 million in loans to certain PRI-backed unions, who in turn donated the cash to the PRI’s then-presidential candidate Francisco Labastida, who still lost handsomely), embarrassing Televisa, the PRI and Peña Nieto.

Putin inaugurated for third term, announces Medvedev as PM, amid Moscow protests

Vladimir Putin was sworn in as president today, amid protests across Moscow, following his election on March 4 in a vote widely seen as problematic and fraudulent.

Putin, whose term will run through 2018, also appointed former president Dmitri Medvedev as his prime minister — the appointment had been expected, but was not entirely certain.  Medvedev served as prime minister previously under Putin until his election in 2008 as president.  Putin, in turn, had served as prime minister during the entirety of Medvedev’s presidency.

Perhaps the more important story, however, are ongoing protests in Moscow, which flared over the weekend and drew tens of thousands in protest of Putin’s inauguration:

A number of demonstrators were injured by riot police, who wielded batons in clearing crowds from Bolotnaya Ploshchad, the site of a planned opposition rally Sunday evening to protest Monday’s presidential inauguration. Seventeen people requested medical care for injuries sustained during the event, a hospital source told Interfax.  Around 450 protesters and opposition leaders Alexei Navalny and Sergei Udaltsov were arrested, police said….

Despite the event’s ambitious name, “March of Millions,” organizers did not expect Sunday’s event to draw the estimated tens of thousands who attended.  City Hall had given advance approval for 5,000 participants to take part in the march  and rally.

Protestors came out in force after last December’s blatantly fraudulent parliamentary elections, as well as in the days leading up to and immediately following the March 4 presidential vote, although a show of force on the streets of Moscow on March 5 had appeared to stall the momentum from any such protests — until this weekend.

Ironically, as police were clashing with protestors who were demanding a more democratic Russia, Putin promised in his short inauguration speech to ‘strengthen Russian democracy.’
