Labour victory could bring Kinnock into heart of British government

Twenty-three years ago, Neil Kinnock was expected to defeat a tired Conservative Party, reeling after three full terms in government that barely seemed capable of limping into its fourth.United Kingdom Flag Icon

Instead, Tory prime minister John Major won the 1992 election, against all expectations, thwarting Kinnock’s second chance at restoring Labour to government. Kinnock stepped aside as leader, and his role in Labour’s revitalization was quickly marginalized with the election of Tony Blair as Labour leader in 1994 and Blair’s landslide ‘New Labour’ victories in 1997, 2001 and 2005.

But when Blair’s successor, Gordon Brown, lost the 2010 election, the ‘New Labour’ label had become tired and somewhat toxic. Moderate voters blamed Brown for the excesses of the financial crisis and, more fundamentally, opposed Blair’s involvement in the US invasion of Iraq and the growth of what critics called a widening police state across Great Britain. Moreover, progressives and the labour union activists that had historically been at the heart of Labour wanted a new approach that recovered some of the social democratic populism with which Labour was once synonymous.

It was no shock, then, when Neil Kinnock emerged as a leading adviser to the lesser-known Ed Miliband in his attempt to win the Labour leadership crown in 2010.

Miliband, of course, famously succeeded, defeating his own brother, former foreign minister David Miliband, on the strength of his support from labour unions and activist groups, which represented one of three equal constituencies in the Labour leadership contest (Ed lost the other two among Westminster MPs and among regular Labour party members).

From the start of the Ed Miliband era, then, Kinnock has been a close informal adviser and mentor to the young Labour leader, marking something of a rehabilitation for a former Labour leader who himself came just shy of becoming prime minister. Kinnock’s daughter-in-law is Danish Social Democratic Party leader Helle Thorning-Schmidt, since October 2011 the prime minister of Denmark. Her husband, Stephen Kinnock, is widely favored to win election to the House of Commons this week as a Labour MP for the Welsh constituency of Aberavon.

As the election approaches this week, Kinnock has been as much of a hindrance as a help to Miliband — just as Kinnock did, Miliband struggles to project a convincing image that he will be an effective prime minister. The comparison has not been to Miliband’s advantage. Over the weekend, Miliband unveiled an eight-foot stone monolith carved with key Labour pledges. The stunt was met with wide derision from social media and elsewhere — one Telegraph columnist called it Miliband’s ‘Kinnock moment.’

What to make of Cameron’s night of the long knives

It wasn’t a surprise that British prime minister David Cameron sacked Kenneth Clarke, the one-time self-proclaimed ‘big beast’ of the Conservative Party from government. United Kingdom Flag Icon

At age 74, the pro-Europe former chancellor, who began his ministerial career in Edward Heath’s government of the early 1970s, had already been demoted once from justice secretary, his progressive ideas for penal reform and lighter sentencing guidelines  thwarted by the Tory right two years ago.

But it was something of a surprise that Cameron sacked so many other high-profile members of his cabinet last night.

Foreign secretary William Hague (pictured above with Queen Elizabeth II), one of the most high-profile Tories inside or outside government will now become the Commons leader. Hague, once a strident eurosceptic, was elected leader of the Conservative Party in the aftermath of Tony Blair’s massive victory in 1997. He stepped down in 2001 after his failed campaign to return the Tories to power. Though just 53 years old, Hague also announced he would also leave office at the 2015 elections, cutting short what’s been a solid career, if not one that might have elevated Hague to the premiership under different conditions.

His replacement is defence secretary Philip Hammond, another Conservative firebrand, who has ably worked with chancellor George Osborne to reign in spending while the United Kingdom has reduced its role in the US-led occupation in Afghanistan. Hammond, who served as Osborne’s deputy in opposition, comes from the right wing of the party, however, having opposed Cameron’s push to legalize same-sex marriage last year. He’s not known as a particularly charismatic figure, and he’ll have a hard time shaking the notion that he’s No. 11’s man at the foreign office. 

Having argued that the United Kingdom should leave the European Union without significant, additional British carve-outs, Hammond will now be tasked with salvaging the UK-EU relationship.

But the knives went longer and deeper still — David Willetts, the minister for universities and science, nicknamed ‘Two Brains’ and deemed one of the cabinet’s most thoughtful members; David Gove, the combatively conservative and stridently eurosceptic education minister; Dominic Grieve, the attorney general; Owen Patterson, the environmental secretary.

The semi-official word is that Cameron’s reshuffle represents an effort to put his cabinet and his government on footing to wage next May’s general elections, with a particular focus on elevating the number of women and younger Tories to higher positions.

To borrow a phrase from former US president Bill Clinton, a ‘cabinet that looks like Britain.’

Clarke’s British reform failures a lesson as Holder pushes for historic turn on U.S. crime

As U.S. attorney general Eric Holder makes a serious push for prison and justice reform in the United States, he would do well to look at a similar push across the Atlantic — Kenneth Clarke’s attempt to reverse decades of tough criminal law policies in the United Kingdom provides a cautionary tale.USflagUnited Kingdom Flag Icon

Holder announced yesterday in a speech to the American Bar Association that the U.S. justice department will seek to avoid mandatory sentences for non-violent, low-level drug-related offenses, and justice reform advocates largely cheered a welcome pivot from the ‘tough-on-crime’ approach to justice that’s marked U.S. policy for the past four decades throughout much of the ‘War on Drugs’ — drug-related offenses have largely fueled the explosion in the U.S. prison population.  Holder will instruct prosecutors in federal cases not to list the amount of drugs in indictments for such non-violent drug offenses, thereby evading the mandatory sentences judges would otherwise be forced to administer under federal sentencing guidelines.  That’s only a small number of prisoners because 86% of the U.S. prison population is incarcerated by state government and not by the federal government.

Holder called for ‘sweeping, systemic changes’ to the American justice system yesterday and attacked mandatory minimum sentences for non-violent offenders, which he said caused ‘too many Americans go to too many prisons for far too long and for no good law enforcement reason.’

That approach has left the United States with a prison population of nearly 2.5 million people (though the absolute number has declined slightly after peaking in 2008) and the world’s highest incarceration rate of 716 prisoners per 100,000 .  That’s more than Russia (484), Brazil (274) the People’s Republic of China (170) or England and Wales (148) and as Holder noted yesterday, the United States has 5% of the world’s population but 25% of the world’s prisoners.

Particularly damning to the United States is that 39.4% of all U.S. inmates are black and 20.6% are Latino, despite the fact that black Americans comprise just 13% of the U.S. population and Latinos comprise just 16%.  Holder yesterday cited a report showing that black convicts receive prison sentences that are around 20% longer than white convicts who commit the same crime.  Holder denounced mandatory minimums as ‘draconian,’ and made an eloquent case that U.S. enforcement priorities have had ‘a destabilizing effect on particular communities, largely poor and of color,’ that have been counterproductive in many cases.  Holder also made that case that in an era of budget cuts, America’s incarceration rate is a financial burden of up to $80 billion a year, and that reducing the U.S. prisoner population could shore up the country’s finances as well.

But Holder — and prison reform advocates that have emerged on both the American left and right — face a heavy task in reversing nearly a half-century of crime legislation that has largely ratcheted up, not down.

Just ask Kenneth Clarke, who until last September was the justice minister in UK prime minister David Cameron’s coalition government, who as one of the longest-serving and most effective Tories in government for the past four decades, faced a tough road in enacting prison reform in England and Wales.

Though its prison population and incarceration rate pales in comparison to that of the United States, the British justice system imprisons more offenders than many other countries in the European Union, such as France (101 prisoners per 100,000) or Germany (80).

Cameron faced a delicate task in finding a role for Clarke in his government back in mid-2010.  Clarke, a self-proclaimed ‘big beast’ of Tory politics got his start under ‘one nation Tory’ prime minister Edward Heath and found his stride under Heath’s successor, Margaret Thatcher.  He became John Major’s chancellor of the exchequer, guiding No. 11 from the dark days of the 1992 ‘Black Wednesday’ sterling crisis to a more robust financial position.  When Labour swept to power in May 1997 under Tony Blair, Clarke immediately became the most popular Conservative in the country, even though the significantly more right-wing and increasingly euroskpetic party thrice denied the pro-Europe Clarke its leadership.  While Clarke may have passed his glory days in government, his appointment as justice minister reflected that Clarke could still be useful in government.

Cameron reshuffle nudges UK government rightward

UK prime minister David Cameron announced his first major cabinet reshuffle Tuesday since taking office in May 2010.

As predicted, justice minister Kenneth Clarke was demoted to ‘minister without portfolio,’ marking what will likely be the end of front-bench politics for the ‘big beast’ of Tory — and British — politics, and for his thoughtful take on prison reform.  He’ll be replaced by the far more right-wing (and non-lawyer) Chris Grayling, an up and coming figure on the Tory right, who had previously served as employment minister.  From The Guardian:

Grayling’s appointment also signals a determination by Cameron to take a tougher line on sentencing, the Human Rights Act, legal aid and community punishment, a nexus of policy issues that has left Conservative backbenchers frustrated by what they regarded as Clarke’s willingness to pander to Lib Dem opinion.

Lady Sayeeda Warsi, the only Muslim in the cabinet and a one-time rising Tory moderate star, was also demoted, from co-chair of the party to senior minister of state at the Foreign Office.

Cameron’s reshuffle among junior ministerial offices was much more thoroughgoing, and also marks a significant swing to the right — and a swing to a cabinet that is ‘more male, white, southern and Oxbrigdge’.  The net effect will be to isolate further deputy prime minister Nick Clegg, the leader of the Liberal Democrats.  Chancellor George Osborne will keep his job, meaning that there’s no shift from the budget austerity upon which Cameron has staked his government’s legacy.

Is Kenneth Clarke — and his experiment with prison reform — finished in British politics?

Longtime observers of British politics will note with some alarm recent reports that justice minister Kenneth Clarke may be headed out of UK prime minister David Cameron’s cabinet, pursuant to a widely expected cabinet reshuffle in early September.

To contemplate this is to see the final curtain drawn on one of the ‘big beasts’ of British politics in the past three decades — as has been noted, Clarke won his first ministerial role when UK chancellor of the exchequer George Osborne was just one year old.

The Telegraph reports that Cameron is considering replacing Clarke with Iain Duncan Smith, the work and pensions secretary (and the ill-fated former leader of the Tories from 2003 to 2005), or Nick Herbert, a junior justice minister.  Even more odd is the way in which Clarke has issued a statement on the potential reshuffle:

“I have never had any conversations of any kind with the Prime Minister or anyone acting on his behalf about a reshuffle. I am totally laid back about a reshuffle and am waiting to see whether or not it affects me,” he said.

Clarke is, simply put, one of a kind: a bloke in a party of toffs.
